<br />Deceased.. } Now,on this 16th day of August,1920,this cause cause came
<br />on for hearing upon the petition of Albert v.d.Iieyde,heretofore filed herein,praying for a seat -'I
<br />lement of the estate of said deceased,a determination of his heirs, their degree of kinship.a.nd
<br />the right of descent of his real estate.said petitioner being represented by Horth & Ryan,his
<br />attorneys,and it appearing from the proof on file herein that due and legal notice by publicatio%
<br />in the "Grand Island Independent ",a legal newspaper published in Hall County,Nebraska,for three'
<br />successive weeks,as by law and the orders of this Court required.has been given to all creditors,
<br />and heirs at law and persons interested in said estate.of the filing of said petition,the time
<br />and place for hearing thereof,which time was more than thirty days and less than sixty dale
<br />after the filing of same.and there being no objections thereto,said cause was duly submitted to
<br />the Court on said petition and the evidence of petitioner in support thereof.and the Court being
<br />duly advised in the premises finds that the allegations in said petition are true,that the
<br />said'Charles A.Wiebe died intestate at his home in Hall County,Nebraska,and while a resident and
<br />inhabitant thereof,on March 13.1901;that more than two years have elapsed since his death and no
<br />application has been made in the state of Nebraska for appointment of an administrator of his
<br />estate,nor petition filed therefor.and no administration has even been had upon his estate at
<br />any time or place.
<br />The Court further finds that the said deceased was married at the time of his death and left
<br />surviving him as his heirs,and only heirs at law.his widow,Florence H.Wiebe,and his son.Fred
<br />A.Wiebe, their degree of kinship being that of surviving wife and child of said deceased-that
<br />said deceased died the owner of and seized of an estate of inheritance in the following describ-
<br />ed property situate in Hall County, Nebraska, to+wi t: All that part of Lot Number Eight (8) of the
<br />County Subdivision of the west half, of the southwest quarter of Section Fifteen (15 ).in Township
<br />Eleven (11) North,Range Nine (9) West of the Sixth P.M., which lies east of Lot Number Nine (9)
<br />Of said Subdivision,being a rectangular piece of ground two rods wide east and west by eleven
<br />rods and six inches long north and south,which' real estate did,on the death of said deceased,pas
<br />and descend,'by operation of law,under the law of descent then in force in the state of Nebraska,
<br />to the said Fred A.Wiebe,son of said deceased,subject to the dower interest and life estate they -
<br />in of said Florence H. Wiebe,widow..
<br />The Court further finds that said Allbert v*4*-Heyde did,on or about December 2,1905,purchase
<br />the above described real estate from the said Florence H.Wiebe,widow,and Fred A.Wiebe,son.of
<br />said deceased,both of whom were at said time unmarried and over the age of twenty -one years,und
<br />same was conveyed to him by warranty deed which is recorded in Book 39 of Deeds at page 9 of the
<br />records of Hall County.Nebraska,and that said petitioner is still the owner of said premises,and
<br />as such owner is a proper and qualified person', to file this petition and prosecute this cause;
<br />that more than two years have elapsed since the death of said deceased,that he died intestate.
<br />that his funeral expenses and other debts have',been paid.and that all -claims or debts of said
<br />estate of said deceased,if any exist, are forever barred and precluded,and that the costs of
<br />these proceedings have been paid by said petitioner,and that said petitioner is entitled to a
<br />decree as prayed in his adid petition.
<br />IT IS TITCREFORF BY THE COURT ORDFRED,ADZrUDG9+D,ANT) DECREED. that the said Charles A.Wiebe died
<br />intestate at his home in Hall County, Nebraska. and while a resident thereof.as above set forth,
<br />more than two years prior to the filing of the, petition in this cause, that no application for
<br />appointment of an administrator upon his estate has ever been made,nor has any administration
<br />upon his estate ever been had in the state of gebraska,or at any other place;that he died seized
