<br />Now on this 4th day of August, 1920, this cause came on for hearing upon the final report of
<br />Ralph R.Horth, administrator of the estate of Sarah R.Sutherland,- deceased, and the court having

<br />examined the records and files and being fully advised in the premises,�finds that due and legal
<br />f
<br />notice has been given to all persons interested in said estate of the time and p3.Ace fixed for

<br />hearing upon the final report of said administrator, as heretofore ordered by the court and in

<br />the manner provided by law.
<br />And the court having examined the report of said administrator, together with the vouchers on
<br />file and heard the evidence, finds that said report is true and correct in all things, and that
<br />j
<br />the same ought to be allowed and approved as and for the final report of said administrator, sai
<br />!

<br />rged and said estate closed.

<br />The court further finds that due and legal notice has been given of the time and place fixed for

<br />filing claims against the estate of the said Sarah R. Sutherland, deceased, that the time so-
<br />fixed has fully expired, and that all peeons having claims against said estate, if any such than
<br />be, are forever barred and precluded from setting up or asserting any such claims against said
<br />estate.

<br />The court further finds that the said Sarah E.Sutherland depated this life intestate at her home

<br />in Grand Island, Hall County, Nebraska, and thajt at the time of her death the said Sarah R. Suth-

<br />erland was a resident and inhabitant of Hall County, Rebraska; that she left surviving her as he
<br />i

<br />heirs at law and her only heirs at law, J.W. Sutherland, her surviving husband and father of all
<br />her children and Thurza M.Doyle, Mollie Gensley,, Blanche Kanoff, Jessie Sutherland and Florence
<br />Sutherland, daughters all of whom were of legal age at the time of the death of said Sarah E.:" _.
<br />Sutherland; that the said Sarah E Sutherland died seized as the owner in fee simple of Lots

<br />Numbered Six (6) and Seven (7), in Block Number Twenty -four (24), in Russel Wheeler's Addition
<br />I to the city of Grand Island, in Hall County, Nebraska; that under the intestate laws of the State
<br />of Nebraska, in force at the time of the death of said Sarah R.Sutherland, said real estate,

<br />above described, passed and descended by absolute title as follows: an undivided one= othird to
<br />the said J.W.Sutherland, surviving husband of said deceased, and an undivided two - thirds to the
<br />i
<br />said Thurza M. Doyle, Mollie Gensley, Blanche Unoff, Jessie Sutherland and Florence Sutherland,
<br />daughters of said deceased, share and share alike; that by writing, in due form, a copy of which
<br />is attached to the final report of said administrator, the said T.W.Satherland, duly assigned to

<br />his daughters, Thurza M.Doyle, Blanche Kanoff, 'Mollie Gensley, Jessie Sutherland, and Florence

<br />Sutherland, all his right, title and interest in and to the personal estate of the said Sarah E.

<br />Sutherland, deceased, and as such assignees they became the owners of all of the personal estate
<br />of the said Sarah E.Sutherland, deceased; that by writing duly signed, witnessed, acknowledged
<br />and delivered, a duplicate copy of which is attached to the final report of said administrator,
<br />the J.W.Sutherland, Thurza M.Doyle, Mollie Gensley, Blanche Kanoff, Jessie Sutherland and
<br />said
<br />Florence Sutherland, duly assigned and conveyed to Ralph R.Horth, as trustee, a certain note and
<br />mortgage executed by Victor Danezek and wife, for $14,228, bearing date February 8. 1918, due
<br />bearing interest at 6 per centum per annum from March 1,1918.
<br />March 1,1928, ,,and payable to the order of said J.W.Sutherland and said Sarah E.Sutherl.and, said
<br />mortgage covering the North half of the Northeast Quarter, the Southeast Quarter of the Northeast
<br />Quarter, and Lots 3 and 4, in Section 25, Township 19, North Range 14, West of the 6th P.M.,
<br />which said mortgage is recorded in Book 46 of Mortgages, at Page 409, of the records of Valley
<br />°
<br />County, Nebraska, to hold the same in trust under the terms and provisions of said trust agree -
