<br />Alonzo B. Fisher, Deceased.
<br />Now on this 22" day of July,1920, this cause came on for hearing upo
<br />the ;petition of Annie B. C,pin,here tofore filed herein,praying for a settlement of the estate of'�
<br />said deceased,a determination of his heirs,their degrees of kinship and the right of descent of is
<br />real estate,sai.d petitioner being represented by T.L.Cleary,her attorney and it appearing from
<br />the proof on file herein that due and legal notice by publication in the "Grand Island Independent ",
<br />w legal newspaper published in Hall County,Nebraska,for three successive weeks as by law and the;
<br />i
<br />orders of this Court required,has been given to all creditors,heirs itt law and persons interested
<br />'I
<br />in said estate, of the filing of said petition and the time and place for hearing thereof,which
<br />time was more than thirty days and less than sixty days after the filing of same,and there being,
<br />no objections thereto,said cause was duly submitted to the Court on said petition and the evid -n e
<br />of petitioner in support thereof,and the Court being, duly advised in the premises,finds that the(

<br />allegations in said petition are true,that the said Alonzo B.Fisher died intestate at Midland, l
<br />Texas on the 14" day of xugust,1904 and that at the time of his death he was a resident and an
<br />inhabitant of said Yidla.nd,Texas;that more than two years have elapsed since his death and no
<br />application has been made in the State of Nebraska,for the appointment of an administrator of 5
<br />his estate,nor petition filed therefor and no administration has been had upon his estate at
<br />any place.
<br />The Court further finds that the said deceased left surviving him as his sole and only heirs
<br />at law his widow,Annie B.Chapin,(f ormerly Annie B- Fisher),u daughter, Cecil I.Fisher and a son p
<br />,i
<br />Alonzo Boyd Fisher, all of Fort Fairf ield,16ine and all of legal age. That said deceased died, seiz; d
<br />as the owner in fee simple of an estate of irheritance in the following described real estate sit-
<br />uated uated in Hall County,Nebraska,to -wit: Lot Five (5) in Block Three (3) in Dodd and Marshall's Add
<br />itiun to the Village of Wood River in Hall County,Nebraska, which real estate did,on the death
<br />of the said Alonzo B. Fisher, deceased, pass and descend,by operation of law, under the late of desce�t,
<br />then in force in the State of Nebraska, to the said Cecil I. Fisher "rid Alonzo Boyd Fisher, son
<br />and daughter of said deceased,in equal shares,as tenants in common,subject to the dower rights
<br />the said Annie B.Chapin,as widow of said deceased,a.nd that the degrees of kinship of said heirs
<br />ut law to said deceased were that of surviving widow,son "aid d"ughter,respectively.
<br />The Court further finds that more than two years have elapsed since the death of said deceased;

<br />that he died intestate;that his funer"i expenses and all other debts haite been fully paid and thj t
<br />all claims or debts of said estate and of said deceased,if any exist,are forever barred and pre".
<br />cluded,andthe costs of these proceedings have been paid by the petitioner.
<br />It is therefore, by the Court,ORDERFD,AD.TUDGED and DECREED that the said Alonzo B.Fisher, died I
<br />intestate,as above st"ted,more than two years prior to the filing; of the petition in this cause;;!
<br />that no application for the appointment of an administrator of his estate has ever been made,no`
<br />has any administration upon his estate been had in the State of Nebraska, or at any other place;
<br />that he died seized as the owner in fee simple of an estate of inheritance in the real estate
<br />above described situated in Hall County,Nebraska and that upon his death the same passed and deol-
<br />cended,by operation of law,in equal shares to his daughter,Cecil I.Fisher and his son Alonzo
<br />Boyd Fisher,as tenants in common,subject to the dower interests and estate of his said widow,
<br />Annie B.Chapin ( formerly Annie B.Fisher) and is so awarded to them;that said deceased left sur-
<br />viving him as his only heirs at law his said widow,Annie B. Chapin .(formerly Annie B.Fisher) his
<br />daughter,Cecil I.Fisher and his son,Alonzo Boyd Fisher,who bore the relations to him as above s
<br />forth and that the said Annie B.Chapin, (formerly Annie B.Fisher) is the petitioner in this caul
<br />and a proper and qualified person to file the said petition and prosecute said cause;that all
