<br />Now, on this 12th day of July,1920, this cause 'came on for hearing
<br />upon the final report of Charles G.Ryan,Exeeutor of the above entitled estate and his petition

<br />a 'final_settlement thereof,and it appearing from the proof on file herein that due and legal notlace
<br />b publication .as b law and the orders of this Court required. had been
<br />y p y q given to x.11 persons
<br />interested in said estate of the filing of said final report and the petition,and the time and
<br />place for hearing thereon,and said time having expAred and there being no objection to slid repo(irt,

<br />on examination the Court finds the same to be in all respects correct and same-is hereby approved
<br />and allowed as the final report of said Executor.
<br />The Court further finds from the proof on file herein that due and legal notice,us by law
<br />the orders of this Court required,has beer. given to all creditors of said estate and persons hav��ing

<br />claims against same,of the time and place fQr filing sume,and that said time has fully expired.a�d
<br />I
<br />that all claims against s,,id estate have been fully paid by said Exeeutor,including the _expensep
<br />of adninistrution,and that all other debts and claims against said estate, if any exist,, are for-1

<br />ever burred and precluded..
<br />The Court further finds that the said Emma Splinter died testate at her home in Hall Coun
<br />Nebraska,on ;march 19,1919,that she died seized of the following described real estate situate in
<br />Hall County,Nebrasku; hot Number Four (4),in Block Number Thirty-three (33) in the Original Town
<br />now City,of Grand Island,Nebraska,4nd that under the terms and provisions of the will of said
<br />deceased. whith has been duly proven, allowed, and admitted to probate in this Court,said above
<br />described real estate passed and descended to William Splinter,surviving husband of said decease
<br />for his use and benefit during his natural lifetime,und subject to his life estate therein,the f
<br />simple title thereto was devised by said deceased,in equal shares,to Marie.Wiegert,Christina
<br />W iegert,AugustLu'Viiegert,Emr"u, Rudclph,und Anna Wiegert,as tenants in common, the said remaindermer
<br />being required to pay all taxes assessed agaiftt said premises during the period of the 73Jfe eel
<br />of said William Splinter therein,and said real estate is so awarded to said life tenant and re-
<br />maindermen as provided by said will.
<br />The Court further finds that the said Executor has accounted for all and singular of the pro -
<br />perty_and estate coming; into his hands as such Executor,and has paid all of the debts of said
<br />estate and all special legacies to the persons entitled thereto,and filed his receipts therefor
<br />this Court,as shown by said final report;that after the payment of suid debts,expenses of ad-
<br />ministration,and special legu.cies,as provided insaid will.here remained for distribution among 1
<br />grandchildren of said deceused,as provided by the eighth clause of the ivill thereof,the sum of
<br />$5637.01,and the suave should be distributed under said will to said grandchildren of suid decea,,
<br />us they respectively come of age,in the following proportions:
<br />One -fifth to the living children of Frederick Wiegert $1127.40
<br />One- firth to the living children of Herman Wiegert 1127.40
<br />One -fifth to the living children of John Wiegert 1127.40
<br />One -fifth to the living children of Emma Rudolph 1127.40
<br />One -fifth to the living children of Henry Wiegert 1127.40
<br />That said Executor has paid out of said residue remaining in his hands to said legatees name(
<br />in the eighth clause of said will the following amounts,said legatees being more than twenty-
<br />years of age,and has filed their receipts therefox,to -wit:
