<br />04 "Nap, more than two years prior to the filing of jthe petition in this cause; that no application for
<br />appointment of an administrator of her estate has ever been made,nor has any administtation upon';
<br />her estate been had in the state of Nebraska,or at any other place;that she died seized as the
<br />owner in fee of an eslate of inheritance in the real estate above described situate in Hall
<br />County,Nebraska,a.nd that upon her death the same passed and descended,by operation of law and
<br />under the law of descent in Nebraska then in force,in equal shares to her above named childredn
<br />as tenants in common,and the same is so awarded to them as of the date of her death, subject
<br />to the :Ji-fe estate and interest of William H.Gideon,her surviving husband, therein,which fit: 'e ew
<br />tate has terminated and ended by reason of the death of said William H. Gideon. surviving husband,
<br />-s4nce the death of said'deceased;that said deceased left surviving her as her only heirs at law
<br />her husband, William H.Gideon,now deceased,and her children,Florence Weaver,Sarah Zahn,Fdyth
<br />E. Slater,M.rcellus E.Gideon,Grover G.Gideon,David C.Gideon.and William H.Gideon,who bore the
<br />relation to her of surviving husband and children and that on or about April 26,1915,the said
<br />Henry E.Clarno,petitioner herein,purchased from the above described children and heirs at law
<br />of said deceased, the said above described premises.and is now the owner thereof under purchase
<br />and due conveyance to him from said heirs at law of said deceased.his deed of conveyance being e-
<br />corded in Book 49 at page 373 of the records of Hall County,Nebraska,and that as such owner he
<br />is interested in this cause and a proper and qualified person to prosecute the same,and is entil-
<br />led to have this decree establishing'the heirs and the right of descent to them of said propert*
<br />duly entered herein;that all debts of said deceased,if any there be, and of her estate, are for ver
<br />w
<br />barred and precluded; that further administration of the estate of said deceased is hereby dispe , died
<br />i
<br />with and said estate settled and forever closed.
