<br />IN THE COUNTY COURT OF HALL COUNTY,NFBRASKA.

<br />Now, on this 3rd day of July,1920, this cause came on for hearing upon the petition of Henry
<br />E.Clarno,heretofore filed herein,praying for a settlement of the estate of said deceased,a det-
<br />ermination of her heirs,their degree of kinship,and the right of descent of her real estate,said
<br />petitioner being represented by Horth & Ryan,'his attorneys,and it appearing From the proof on
<br />file herein that due and legal notice by publication in the "Grand Island Independent ",a legal
<br />newspaper published in said Hall County,Nebraska,for three successive weeks as by law and the
<br />orders of this Court required,hus been given to all creditors,heirs at law,and persons interest-
<br />ed in said estate,of the filing of said petition and the time and place for hearing thereof, which
<br />time was more than thirty days and less than sixty days after the filing of same,and there bei
<br />no objections thereto,said cause was duly submitted to the Court on said petition and the evi-
<br />dence of petitioner in support thereof,andithe Court being duly advised in the p remises,finds
<br />that the allegations in said petition are true,that the said Lydia B.Gideon died intestate at
<br />her home in Hall County, Nebraska. and while a resident and inhabitant thereof,on August 20,1592;
<br />that more than two years have elapsed since her death,and no application has been made in the
<br />state of Nebraska for the appointment of an administrator of her estate,nor petition filed there
<br />fcr.and no administration has ever been had upon her estate at any time or place.
<br />The Court further finds that the said deceased was married at the time of her death,and legt
<br />surviving her as her heirs and only heirs at law the following damed persons:William H.Gideon
<br />(now deceased) her husband,and her children as follows: Florence beaver (formerly Gideon),Sarah
<br />Zahn (formerly Gideon), Edyth E.Slater (formerly Gideon),her daughters,and Murcellue E.Gideon,
<br />Grover G.Gideon,David C.Gideon,and William H.Gideon,her sons,their degreefkinship being that of
<br />surviving husband and children of said deceased,all of whom were of legal age.
<br />That said deceased died the owner and seized of an estate of inheritance of Lot Number Four
<br />(4) in Block Two (2) in Gideon's Addition to Doniphan,Hall County,Nebraska, as.shown by the re-
<br />corded plat thereof,which real estate did,on the death of said deceased,pass and descend,by ope
<br />ation of law, under the law of descent then in force in the state of Nebraska, to the said Florence
<br />Weaver,Sarah Zahn,Edyth E.Slater,Mareellus E.Gideon,Grover G.Gideon,David C.Gideon,and William
<br />H. Gid.eon,children of said deceased,subject to the curtesy rights therein of William H- Gideon,
<br />her surviving husband which was an interest for life only,and which was terminated by the deathll
<br />of said William H.Gideon; that said above named children and heirs at law of said deceased took'
<br />title to said premises as tenants in common;that said William H.Gideon,surviving chusband of
<br />said deceased,died subsequent to the death of his said wife,and that by reason of his death his
<br />life estate and interest in said premises ended and were determined.
<br />The Court further finds that more than two years have elapsed since the death of said deceased;
<br />that she died intestate,that her funeral expenses and other debts have been fully paid, and that
<br />all claims or debts of said estate and of said deceased,if any exist,are forever barred and pre-
<br />cluded, and that the costs of these proceedings have been paid by said petitioner. that on or
<br />about April 26,1915,Henry E.Clarno, petitioner herein. pure hased from said above described c hildr n
<br />and he lls at law of said deceased,said above described property and received therefor a deed
<br />of conveyance to him,which is recorded in Book 49 at page 373 of the records of Hall County,
<br />Nebraska, is now the owner of said premises and a proper and qualified person to file this pe-
<br />tition and prosecute this cause.
<br />IT IS =MFDM BY THE COURT ORDERED, ADJUDGED, AND DECREED, that the said Lydlu B.Gideon died
<br />intestate at her home in Hall County, Nebraska,and while a resident thereof, as above stated
