<br />The Court further finds that said Margaret McDermott,..ole heir of John D.McDermott,deceased,
<br />d-led intestate in Columbus,Ohio,on the 25th•day of August,1917,1eaving her surviving as her
<br />heirs at law and only heirs at law and next of kin, the petitioner,Thomas C.McDermott,Alice L.
<br />McDermott and Mary E.Baker,abovs named and that said petitioner,Thomas C.MeDermott,derived title
<br />under the Statutes of descent then in force in the State of Nebraska to an undivided one third
<br />interest in fee simple of the above described real estate as tenant in common with his two sis-
<br />ters above named and was therefore entitled and qualified to file said petition in the estate of
<br />John D.McDermott,deceased, for the purposes therein set forth..
<br />IT IS THEREFORE ORIE!MD,CONSI1ERFD,AD,?UDGED AND TECREED,that the said deceased,John D.McDermott,
<br />died intestate more than two years prior to the filing of said said petition in this cause;that
<br />no application for the appointment of an administrator has been made,nor has-any administration
<br />been hdd on his estate in the State of Nebraska;that he died seized in fee simple of an estate
<br />of inheritance situate in Hall County, Nebraska, as above described and set forth; that he left
<br />surviving hiaas his only heir at law _the above named Margaret McDermott,who bore the degree of
<br />kinship to him as his mother;that the above described real estate passed and descended to the
<br />said 26rgaret McDermott,his mother,in fee simple,forever,as provided by the Statutes of Descent
<br />then in force,in the State of Nebraska and that the same is hereby so awarded to her;that all
<br />debts of said deceased,,Tohn D.McDermott and his estate,if any exits,are forever barred and pre-
<br />cluded and all further administration of his estate is hereby dispensed with and said estate iit
<br />forever settled and closed.
