<br />petition of Thomas C. McDermott, brother of John D. McDermott, deceased, praying for settlement of
<br />the estate of said deceased,a determination of his heirs,and the right of descent of his real
<br />pdroperty,and the degree of kinship of his heirs at law,and it appearing from the proof on file
<br />herein,that due and legal notice by publication for three sucdessive weeks,as by law and the or -'
<br />ders of this Court required,has been given to all creditore,heirs at law,and persons interested
<br />in sai-d estate, of the filing of said petition and the time and place for hearing, same, which time
<br />was more than thirty days and less than sixty days after the filing of said petition, there being
<br />no objections made thereto,the said cause was duly submitted to the Court upon said petition
<br />i
<br />and the evidence of the petitioner in support thereof,and the Court being duly advised in the
<br />premises finds that the allegations'of said petition are true and that the said'John D.McDermottl,
<br />dies intestate on the 12th day of September,1913 in Franklin County,Ohio while a resident thereo ;;
<br />that more than two years have elapsed since the death of said John D.McDermott and that no appli
<br />cation has been made in zhe btate of hebrasKa for the appointaent of an administrator by the hei
<br />or heir or by persons claiming to be creditors of said deceased and that no administration has b #en
<br />had on his estate therein;that said deceased left him surviving Margaret McDermott,his mother,
<br />aged seventy years,the petitioner,Thomas C.McDermott,a brother aged fifty -four yEbars,Alice L.
<br />McDermott,a sister, aged 47 years and Mary E.Baker,a sister aged 42 years- all residing at Col-
<br />umbus,Ohio;that said Margaret McDermott,mother of deceased,is and was the heir at law and only
<br />heir at law and only next of kin of said deceased;that all his funeral expenses have been paid
<br />and that all debts of said decedent,John D.McDermott and of his estate,hiuve been and are for-
<br />ever barred and precluded;
<br />The Court further finds that said deceased,John D.McDermott,died seized in fee simple (being
<br />estate of inheritance) of the following described real estate situate in the County of Hall and
<br />State of Nebraska, to -wit ::
<br />West One Third (W. *) of Lot Three (3) in Block Sixty -eight (68) in the original town,now city
<br />of Grand Island;which said real estate did,on the death of said deceased,pass and descend,by ope
