<br />The Court further finds that said Executors have duly accounted for all moneys and property
<br />belonging to said estate which has come into their possession or under their control,that they
<br />have paid the funeral expenses of said deceased,and the costs of administr&tion,and have made d
<br />distribution of the remainder of said estate according to the terms and provisions of the last
<br />will and testament of the said- Edward Dearing, deceased.
<br />The Court further finds that the said Edward Dearing departed this life at his home in Hall
<br />County, Nebraska, and at the time of his death he was a resident and inhabitant of Hall County,
<br />Nebr"ska.und that on the 10th day of July,1919,his lust will and testament was duly proven,
<br />allowed,and admitted to probate in this Court.
<br />The Court further finds that due and legal notice has been given to all persons bf the time
<br />and place fixed for filing claims against the estate of the said Edward Dearing;deceased,and
<br />that the time so fixed has fully expired,and that all claims,if any such there be,which were4file
<br />within the time limited in said notice,are forever barred and excluded.
<br />The Court further finds that Katherine Dearing,the legatee and devisee mentioned and described!
<br />in the sixth paragraph of the last will and testament of the said Edward Dearing, deceased, depart d
<br />this life,without issue,prior to the death of the said Edward Dearing. deceased. and that by reason
<br />thereof the devise and bequest to the said Katherine Dearing,under said last will and testament o
<br />the said Edward Dea.ring,decea.sed,merged into and became a part of the bequest and devise to Milli`

<br />The Court further finds that the said Edward Dearing died seized as the owner in fee simple o
<br />Lot two (2) in Block seventy -six (76) of the Original Town,now City,of Grand Island,in H411 Count,
<br />Nebruska.,and that by the terms and provisions of the last will and testament of the said Edward
<br />Dearing, deceased, Lydia Deuring,his surviving widow, takes a life estate therein,
<br />The Court further finds that the provisions contained in the lust will and testament of said
<br />Edward Deuring,deceased,in favor of his wife,Lydib. Dearing,are in lieu of,and are accepted by he
<br />in full of all her rights of whatsoever nature in and to the estate of which the said Edward
<br />Dearing died the owner,and that all the rest,residue,a.nd remainder of the estate of the said Ed-
<br />ward De"ri.ng, deceased, passed to the said Williz7.m T. Dew ring,Edw"rd B. Dearing, Opal Dearing Dugan,

<br />The Court further finds that said Executors haveypld over to William T.Dea.ring,as Trustee for
<br />the said Lydia Dearing,during her natural life,the eight thousand (68000) Dollars mentioned in
<br />third paragraph of the last will "nd testament of the said Edward Dearing, deceased, and hove paid
<br />over to Edward B.Dearing as Trustee for Mabel Green,the sum of $5540.15,and have paid over to
<br />said Edward B.Deuring as Trustee for Martha, Irvin the sum of $5540.15,t0 Opal Dearing Dugan,Ed-
<br />wa.rd B.Dearing.�tnd Wiiliwn T.Dearing,each the sum of $5540.15,"nd to- William T.Deuring as Trustee
<br />for Lillie Dearing Underwood,the said Edward B.Dearing having filed his written declination to
<br />act as Trustee for the said Lillie Dearing Underwood, the sum of $5540.15,and that there remains
<br />nothing farther in the hands of said Executors for distribution.
