<br />Now on this 27th day of March. 1920. this cause carne on for hearing upon the final report of
<br />Henry Eickhoff,Executor of the last will and testament of Charlotte Eickhoff,deceased,all
<br />persons interested in the estate of said deceased having entered their voluntary appearance in
<br />the matter,waived time and further notice and signified their approval of said report,and after
<br />notice by publication.
<br />After a full examination thereof the court finds that said report is correct in all respects
<br />and ought to be approved and allowed as and for the final account of said executor;that said
<br />executor has accounted for all of the estate which come to his possession or under his control
<br />and ttlat�semains no money or other property in his hands for distribution.
<br />The court finds that said executor has paid all debts filed and allowed against said estate,
<br />as well as the costs of administration,fune ral expenses and expense of the last sickness of said
<br />deceased; that notice was giver, to creditors by publication of the time limited and place appoint
<br />ed for filing claims against said estate, that the time allowed for filing claims has fully ex-
<br />pired,and that all claims outstanding against said estate,nor so filed,if any such there:be,are,
<br />therefore forever barred and excluded..
<br />It is, therefore, considered by the court that all persons are forever barred from filing or
<br />setting up any claims or demands against the estate of Charlotte Eickhoff.deceased,and that said
<br />estate is fully settled and closed.
<br />It is further considered by. the court that the report of the executor be and the same hereby
<br />is approved and allowed as and for the final account of said executor and he is discharged of hi
<br />t rus t.
<br />The court finds that the said Charlotte Eickhoff departed this life on the 15th day of Augu s
<br />1919,and that she was at the time of her death a resident of Hall County, Nebraska, and died seize
<br />of real and personal property in said County.end that she left a last will and testament which
<br />instrument was duly proved,, allowed and admitted to probate in this court on the 27th day of
<br />September,1919 and recorded in this office,
<br />The court finds that the said Charlotte Eickhoff died seized in fee of the following des-
<br />cribed real estate situate in the County of Hall and State of Nebraska,to -wit: The East half
<br />of the South East Quarter (EJSE4) and the East half of the South West Quarter (Ej of SW4) of
<br />Section Thirty one (31) in Township Twelve (12) in Flange Twelve (12),and that under the pro-
<br />visions of said last will and testament all of said real estate descended at her death to Henry
<br />Eickhoff,he r husband,for his use and benefit during the term of his natural life,and that 4t
<br />his death said real estate passes and descends under said will to August Eickhoff,Minna Kruse,
<br />children of the testatrix,and Everett Hadenfeld =,,a grandson,in equal shares. Provided, however.
<br />that if the said Everett Hadenfeld shall die before reaching the age of 21 years his share in
<br />said real estate shall pass to and become the property of the said August Eickhoff and Minna
<br />Kruse, they taking all of said property.
<br />It is therefore considered by the court that at the death of the said Charlotte Eickhoff all
<br />of her right, title and interest in and to the above mentioned and described real estate did
<br />pass and descend to her husbend,Henry Eickhoff,for the term of his natural life,and that at his
<br />death the same descends to August Eickhoff,Minna Kruse and Everett Hadenfeld..an undivided one
<br />third part thereof to each of them,with the provision ,however,that if the said Everett Hadenfe7
<br />shall die before reaching his majority,his share in said real estate to be taken by the said
<br />August Eickhoff and Minna Kruse,share and share alike.
