IGLBZ <br />1 <br />1 <br />1 <br />it <br />1 <br />54]_, <br />in Russel Wheeler's Addition to the City of Grand Island,and that said Lot 9 in Block 16 was <br />occupied by the deceased and her husba.nd,Eli Decker,at the time of her death as a homestead.. <br />The court finds that under the provisions of the last will and testament of the said Ellen <br />J.Decker,as modified by the election of Eli Decker,her husband, to take under the law of descent <br />all of the above mentioned and described real estate did pass and descend at the death of the <br />testatrix in the manner following: <br />And undivided one half thereof to Eli Decker in absolute title; <br />An undivided one half of said real estate in trust to Walter Lee Sherich,executor,for the <br />use and benefit of Ida B.Sherich for the term 'of her natur"l life and at her death said half <br />interest to pass and descend to Walter Lee Sherich,Harley Sherich and Vernon Sherich,grand sons <br />of the testatrix, in equal shares and in absolute title subject to the homestead rights of the <br />said Eli Decker in and to Lot 9 in Block 16 in Russel Wheeler's Addition to Grand Island. <br />It is therfore considered by the court that under the law of descent of the State of Nebras <br />under which law the husband elects to take,an undivided one half interest in and to the above <br />described real estate passed-to and became the property of Eli Decker and that under and by <br />virtue of the provisions of the last will and testament of Ellen J.Decker,as modified by the <br />election of said Eli Decker,an undivided one half of said real estate passed and descended at <br />the death of the said Eller. J. Decker to Walter Lee Sherich,during the lifetime of Ida B. Sheric <br />and for her use and benefit,and that at the death of the said Ida B.Sherich the half interest <br />in said real estate,devised to Walter Lee Sherich in trust for her use,passes and descends to <br />C <br />Walter Lee Sherich,Harley Sherich and Vernon Sherich in equal shares,with the right of seleAt- <br />ion to Walter Lee Sherich of his one -third part of said real estate, to have and to hold to <br />and to their heirs 4nd assigns forever,subject,however, to the right of homestead of Eli Dec)tej <br />in Lot 9 in Block 16,in Russel Wheeler's Addition to the City of Grand Island. <br />.T.
