<br />Mieth,deceased and represent to the Court the following eonditions,to -wit:
<br />That August Mieth departed this life as set forth in the petition of August L.Mieth, ,Tr.,leav-
<br />ing property as therein described-That your petitioners herein and August L.Mieth,Jr.,are the
<br />only heirs of said August Mieth-That each of your petitioners is above the age of maturity bein,
<br />of the ages set forth in the petition of August L.Mieth,Jr.,filed herein. That-said August L.
<br />Mieth,Jr.,is the oldest child of said August Mieth and next of kin,that the wife of said August

<br />of Hall County,Nebr. , deceased, respectfully states that said August Mieth, departed this life May
<br />21 "01890;That he was immediately preceeding his death and for many years previous thereto,a re-!,
<br />sident of Hall County and was possessed of a very large amount of real estate in said County,
<br />to -wit:- The East one half of section thirty three in town Twelve,Ra.nge 12,a.nd the South half o1i
<br />Range 32
<br />the South East Quarter of Section thirty five, town 12.�a nd the South East Quarter of the South
<br />Test Quarter of Section thirty five,town twelve and Lange twelve,all in Hall County and State
<br />of Nebraska of the value of five thousand dollars.
<br />Your petitioner further shows that no last will or testament . of the deceased has been found,
<br />nor is your petitioner aware that there is any will in existence and your petitioner believes
<br />that the deceased died intestate,
<br />Your petitioner further states that the wife of the deceased died many years since and de-
<br />ceased at time of death was a widower and had been for seventeen years previous thereto.That
<br />deceased has surviving him only the following children. August L.Mieth,Jr.,age 28 years,living
<br />in Hall County,being your petitioner herein. Emma Ruhsen,age 26 yea.rs,living in Perkins County,
<br />Nebr.Frederick E.Mieth,uge 24 years living in Hall County,Neb.Bertha Mieth,age 21,living in Hall
<br />County,Nebraska.Ida Mieth,age 19 years,living in Hull County,Nebraska.
<br />There are no other decedants of said August Mieth living and the above are the only heirs
<br />at law of the said August Mieth,deceased.

<br />Your petitioner further represents that there are no other persons except the above interested

<br />said estate.That said estate consists
<br />of said real estate
<br />above set forth and a large amount

<br />personal property of about the value
<br />of $3500.00.But that
