Steele, heretofore filed herein, <br />praying for & settlement of the estate of said deceased, a determination of his heirs act law, <br />1 and their degree of kinship, and the right of descent of his real estate said petitioners being <br />represented by Horth & Ryan, their attorneys, and it appearing from the proof on file herein that <br />due and legal notice by publication in the "Grand Island Independent ", a legal newspaper in said <br />county, for three successive weeks as by 1"w and the orders of this Court requirdd, has been give <br />to all creditors, heirs at law, and persons interested in said estate, of the filing of said pe- <br />tition and the time and place for hearing thereon, which time was more than thirty days and less <br />than sixty days after the filing thereof, and there being no objections thereto, said cause wCs <br />submitted to the Court upon said petition and the evidence of petitioners in support thereof,and <br />the Court being advised in the premises finds that the allegations of s"id petition are true, that <br />the said Charles N.Steele died intestate at his home in the city and state of New York, and while <br />i <br />a resident thereof, on July 25,1909; that he was a widower at the time of his death and left no <br />issue or descendants him surviving, and left as his only heir at law, his father,,'William N. Stee <br />then a widower; that more than two years have elapsed since his death and no application has beer <br />made in the state of Nebraska for the appointment of an administrator of his estate, nor petitior <br />filed therefor, and no administration has been had on his estate* <br />The Court further finds that said deceased died seized as the owner in fee of and an estate <br />of inheritance in the northwest quarter of Section 36, in Township 9 North, Range 10 West, in Hal <br />County, . Nebraska, , which real estate did, upon the death of said Charles N. Steele, pass and des- <br />cend, by operation of lt.�.w, to the said William N- Steele, father of said desceased, by absolute <br />title, he, the said William N. Steele, being the only heir at law of said deceased. <br />The Court further finds that more than two years have passed since the death of the said Char- <br />les 17-Steele; that he died intestate; that his funeral expenses and other debts have been fully <br />paid, and that all other claims or debts of said estate, or of said deceased,i -f any exist, are <br />forever barred and precluded, and that the costs of these proceedings have been paid by said pe- <br />titioners, <br />The Court further finds that the said William N. Steele bore the relation and degree of kin- <br />ship of father to said deceased, and he afterwards, on or about August 9,1909, duly sold and con- <br />veyed by good and sufficient deed, the above described premises to said Frederic T. Steele and <br />Elizabeth L.Steele, petitioners herein, who are now the owners thereof, and as such owners are <br />I <br />qualified and proper persons to file said petition and prosecute this cause under the lax of the <br />i <br />I <br />state of Nebraska,. <br />
