<br />The Court further finds that said deceased left surviving her as her only heirs at lav6 the
<br />following named-persons: Oliver W.Eaton, her husband, Harry S.Eaton, her son (your petitioner
<br />herein) and Avis S.Eaton (now Avis S. Tomlinson) her daughter, all of whom were of legal age

<br />The Court further finds that the said deceased died seized as the owner i-b fee simple of the
<br />following described real estate situate in Hall County, Nebraska, to -wit: the northwest quarter
<br />of Section Number 4, in Township Number 10. North of Range 11 West of the Sixth P.M.; also the
<br />morth half of the northwest quarter of Section Number 25, in Township Ten North of Range 12
<br />West of the Sixth P.M.; also Lot Number 1 and the east 25 feet of Lot dumber 2, in Block 4, in
<br />t
<br />Dodds & Marshall's Addition to the Village of Wood River, Hall County, Nebraska, which real es-
<br />tate did, on the death of said Virginia S.Eaton, pass and descend, by operation of law then in
<br />force and effect in the state of Nebraska,, to the said Harry S.Laton and Avis S.Eaton (now Avis ff
<br />S.Tomlinson) in equal shares as tenants in cpmmon, subject to the life estate therein of the
<br />i!
<br />said Oliver W.Eaton, surviving husband, as provided by the law of descent then in effect in the ff
<br />state of Nebraska.
<br />The Court further finds that the said Oliver W.Raton, Harry S.Eaton, and Avis S.Eaton, aftery arcs

<br />conveyed the said northwest quarter of Section 4, in Township 10, North, Range 11 West, by good '
<br />and sufficient deed to William J.Keefer, which deed is recorded in Book 37 of Deeds at page 186
<br />of the records of HL.11 County, Nebraska, and the said William J.Keefer is now the owner in fee
<br />simple of said premises.

<br />The Court further finds that the said Oliver W.&Lton, surviving husband of said deceased, di4 d
<br />on or about September 6,1916,,and that upon hid death all his interest. right, and title in and
<br />to said above described premises owned by the said Virginia S.Eaton at the time of her death,
<br />ceased and terminated.
<br />The Court further finds that the said Harry S.Faton, one of the heirs at law of swid decease f,
<br />did, on or about May 19,1917, convey to the said Avis S.Eaton (now Avis S.Tomlinson),by good an
<br />sufficient deed, all of his interest, claim, and title, in and to slid Lot 1 and the east 25
<br />feet of said Lot 2, in Block 4, in Dodds & Marshall's Addition to the Village of Wood River, iia 1
<br />County. Nebraska, above described, and that said Avis S.Eaton Tomlinson is now the owner of sal

<br />premises..
<br />The Court further finds that no petition or application had been filed in the state of Neb-
<br />raska for the appointment of an Administrator of the estate of said Virginia S.Eaton, deceased,`
<br />that no administration has ever been had upon her estate in the state of Nebraska, that more th n

<br />two years have passed since the death of the said Virginia S.Eaton, that she died intestate, th t
<br />her .funeral expenses have been fully paid, and that all debts of said deceased and of her estatie., '
<br />of any such exist, are forever barred and precluded, and th "t the costs of these proceedings e

<br />been fully paid, and that she left surviving her as her only heirs at law the said Oliver W.Rat n,
<br />Harry S.Eaton. and Avis S.Eaton, who bore the relation and whose degrees of kinship to her ;re re�
<br />that of surviving husband, son and daughter.
<br />IT IS THEREFORE nY TEE COURT ORDERED, AD.TUDGED, AND ]SCREED that the said Virginia S.$aton
<br />died intestate in Mall County, Nebraska„ and while a resident thereof, more than two years
<br />prior to the filing of the petition in this cause; that no application for the appointment of

<br />an administrator of her estate has ever been made:, nor her there been any administration of heir
<br />estate in the state of Nebraska; that she died seized as the owner in fee simple of the real e
<br />tate hereinbefore described situate in Hall County, Nebraska; that she left surviving her as
<br />her only heirs at law the said Oliver W.Eaton, Harry S.Eaton. and Avis S.Eaton (now Avis S. Tbr�-
<br />l-inson), who bore the relation and degree of kinship of surviving husband, son, and daughter,
