<br />Now, :on this 26th day of Jaanuary,1920, this cause come on for hearing upon the petition of
<br />Adelbert W.R,yun, filed on December 31,1919, herein, and the order of this Court made on said date
<br />fixing the date for hearing on said petition as of January 26,1920, and dispensing with publicati'
<br />or further notice thereof, and there being no objections thereto, and upon ra hearing of the said
<br />petition and the evidence of petitioner in support thereof, the Court finds that the allegations
<br />made therein are true and that the prayer of the petitioner should be granted and allowed in all
<br />things..
<br />And said cause coming on further to be heard upon said petition and evidence and being duly
<br />submitted to the Court, and the Court advised in the premises, finds that said Emily W.Miller,..
<br />died testate at her home in Kansas City, Jackson County, Missouri, on August 7,1903, leaving a
<br />last will which was on August 13,1903, filed.,p roven, allowed, and admitted to probate and recorde
<br />in the Probate Court of Jackson County, Missouri, having a jurisdiction of the estate of said de-
<br />ceased as required by the laws of said state, and that a duly authenticated copy of said will and
<br />the probate thereof, certified as by law required, has been presented by said petitioner and file
<br />in this Court as a foreign will, and that said deceased died seized and the owner in fee of the
<br />following described real estate situate in Hall County, Nebraska, which was devised by said will,
<br />to -wit; The westerly twenty-six (26) feet and Four (4) inches of Fractional Lot Seven (7), and th
<br />easterly twenty -six (26) feet and Four (4) inches of Fractional Lot Six (6), all in Fractional
<br />Block Thirteen (13), in Rollins'_.Additio# to the City of Grand Island, and, the westerly twenty -
<br />six (26) feet and four (4) inches of Fractional Lot Seven (7), and the easterly twenty -six (26)
<br />feet and four (4) inches of Fractional Lot Six (6), all in Fractional Block Four (4), in Arnold
<br />& Abbott t s Addition to the city of Grand Island. of the value at the time of her death of about
<br />$125, and that the Court has heretofore dispensed with publiea.tio4 notice of this hearing, Which
<br />said will and the authentication thereof was on the 31" day of Jany 1910- duly Recorded in 139ok-
<br />1 -of Wills at page 89 of the Records of Hall County Nebr.

<br />That under the terms and provisions of said will said real estate was duly devised in fee stmp�e
<br />to Samuel T.Miller, surviving husband of said testatrix, and passed in fee simple thereunder to h
<br />That said Samuel T.Miller afterwards died intestate leaving surviving him as his only heirs at
<br />law his son, Charles H.Miller and his grandson, one Holland R.Cole, and that said Adelbert W.Ryan
<br />is the owner, by purchase, through mesne conveyances, of the above described real estate and is a
<br />proper and qualified person to file said petition and prosecute this cause; that more than two
<br />years have elapsed since the death of Said deceased, and said.f oreign will has never been offered
<br />for probate, proven, or allowed in this Court, nor in any Court in the state of Nebraska, nor )tag
<br />any petition or other proceedings been filed, had, or taken in any Court in the state of Nebrask '
<br />for that purpose, or to probate said estate, and that said will so duly authenticated, should he !in
<br />be admitted and allowed as a foreign will, and same is ordered admitted as the last will and tes
<br />ament of said Emily W.Miller, deceased, and that regular and further administration of her said
<br />estate is hereby dispensed with, and that all debts of said deceased, including her funeral expenses,
<br />have been duly paid, and that all other debts of said deceased, if any exist, are forever barred nd
<br />-precluded. All as by law prolided.. !
<br />IT IS THEREFORE BY THE COURT ORDERED, ADJUDGED, AND DECREED' that the e.aid last will and test ' ent,
<br />so authenticated, of the said Emily W.Miller, deceased, be and hereby is duly proven, allowed,
<br />and admitted to probate in this Court as a foreign will, and than regular and further administration
