<br />Now, on this 6th day of 7u.r.uary.1920, this cause came on for hearing upon the petition of the P14in-
<br />tiff. . anal it appearing to the Court from the proof on file herein that due and legal service
<br />and notice of the pendency of this cause as by law and the orders of this Court required, have
<br />been made a n all of the defendants and Said defendants and all of them have failed to
<br />and give t o
<br />demur„ answer, plead, or appear herein within the time as by law required, were in open Court
<br />thrice solemnly called and came not and default was thereupon entered against all of the said
<br />defendants and all persons claiming any interest of any kind in said real estate or any part the
<br />eof.
<br />This cause coming on further to t* heard upon the petition of plaintiff and the evidence in
<br />support thereof, the sane being; duly submitted to t ie Court, the Court being. duly advised in the
<br />premises, on consideration whereof finds for the plaintiff, and finds that 'the . .allegations :Wade

<br />in plaintiff's petition are true; that he is entitled co the relief prayed for therein; -that at
<br />the time of the commenement of this action the plaintiff was in possession of the premises descri
<br />ed
<br />in his petition, to -wit, Lot Number 8, in Block 134, of Union Pacific Railway Company's Second
<br />Addition to Grand Island, Hail County, Nebraska, w"s the legal owner thereof, and had a fee situp
<br />e
<br />title therein, and that he and his grantors have been in the-continuous, open, adverse, and not-
<br />orious possession thereof under a claim of title to same and al of same for more then ten years
<br />prior to the bringing of this action, and that none of the said defendants,.or any person claimi
<br />under or through them, nor any other person claiming any interest of any kind in said real estate,
<br />or any part thereof, has any estate, title, or interest,, in same, or any part thereof.
<br />The Court further finds that one Arthur C.2.wyer did, on or "bout July 30, 1914, secure in the
<br />manner and as required and provided by law, from the County Treasurer of Hall County, Nebraska,

<br />a County Treasurer's tax deed for said premises. which was duly issued to him on account of de-
<br />linquent taxes legally assessed against same, and that said tax deed was, on July 30. 1914, duly
<br />recoraed in Kook 49 at Rage 181 of the Deeds Records of hail County, Nebraska,, as by law pro-
