<br />The Court further finds that said Gertrude Willer died seized as the owner in fee simple of
<br />undivided one - seventh of the east half of the southeast quarter of Section 13,in Township 11,
<br />North, Range 11 West, in Hall County, Nebraska, and upon her death said real estate passed and
<br />descended, by operation of law, to Heinrich Willer, Julius miller, Hans Willer, Carl Willer, Nich
<br />lous Willer, and Annie Hecht, her sons and daughter, in equal parts as tenants in common, sub-
<br />ject, however, to the estate by courtesy therein of Jurgen Willer, surviving husband of the said
<br />Gertrude Willer, deceased.
<br />The Court further finds that no petition or wpplication has ever been filed in the state of
<br />Nebraska for the appointment of an administrator of the estate of said Gertrude Willer, deceased
<br />and that no administration has ever been had upon her said estate in the state of Nebraska, and
<br />more than two years have passed since the death of the said Gertrude Willer, that she died in-
<br />testate, that her funeral expenses have been fully paid, and that all debts of said deceased
<br />and of her estate, of any such existed, are forever barred and precluded, and that the costs of
<br />these proceedings have been fully paid, and that the said Jacob D. Thode is the present owner of
<br />the_premises hereinbefore described, and is " competent and proper °party to institute and pro-
<br />secute this proceeding..
<br />IT IS THBREFORF ORTZRED, AATUDGFD, AND TIECREED BY THE COURT that the said Gertrude Willer
<br />died intestate at her home in Plymouth, Iowa, on the 5th day of Mare$; ^88?,nd more then two yeaz
<br />prior to the filing of the petition in this cause; thatno application for the appointment of an
<br />administrator of her estate has ever been made in the state of Nebraska, nor has administration
<br />upon her estate in the state of Nebraska ever been had; that the said Gertrude Willer died seized
<br />ws the owner in fee simple of an undivided one - seventh of the real estate hereinbefore described,,
<br />situated in Hall County, Nebraska; that the said Gertrude Willer, deceased, left surviving her
<br />as her heirs at law and her only heirs at law, Heinrich Willer, Julius Willer, Hans Willer, Car
<br />Willer, Nichlous Willer, and Anna Hecht, who bore the relationship to said deceased of sons and
<br />daughter, and Jurgen Willer, surviving husband--.of said deceased; that an undivided one - seventh
<br />of the re.1 estate hereinbefore described and owned by said deceased at the time of her death
<br />passed and descended, by absolute title, upon the death of the said Gertrude Willer, to the
<br />said 'Heinrich Willer, Julius Willer„ Hans Willer, Carl Willer, Nichlous Willer, and Annie Hecht,
<br />in equal shares,.as tenants in common, subject, however, to the estate by courtesy therein of
<br />the said Jurgen Willer,,surviving husband of said Gertrude Willer, deceased.-and the same is
<br />so awarded as provided by the laws of descent of the state of Nebraska in force at the time of
<br />the death of the said Gertrude Willer; it is further ordered, adjudged, and decreed that all
<br />debts of said deceased, 1,f any such there were, and of her estate, if any existed, are forever
<br />barred and precluded, and' that further administration of the estate of the said Gertrude Wille3
<br />is hereby dispensed with and said estate is settled and forever closed.
