<br />Now, on this 22nd day of December,1919, this cause came on for hearing upon the petition of
<br />Jacob D.Thode, the present owner of the east half of the southeast quarter of Section 13, in T

<br />the said Gertrude Willer, deceased, a determination of her heirs, the right of descent of her
<br />estate., and the degree of kinship of said heirs at law, and it appearing to the Court from the
<br />proof on file herein that due and legal notice by publication for three successive weeks, as pro
<br />t
<br />vided by law and the orders of this Court, has been given to all persons interested in said estaj e,
<br />including creditors and heirs at 1"w, of the filing of said petition and of the time and place
<br />fixed for hearing thereon, which time was more than thirty days and less than sixty days after t:
<br />filing of said petition, and there being no objections thereto, said cause was duly submitted to
<br />the Court upon said petition and the evidence in support thereof, and the Court being fully ad-
<br />vised in the premises finds that the allegations contwined in said petition are true, and that
<br />said Gertrude 'Willer, deceased, died intestate at her home in Plymouth. Iowa, on the 5th day of
<br />Murch,1889, and that she was at the time of her death a. resident and inhabitant of Plymouth, in
<br />the state<of Iowa, and that she died seized of an estate of inheritance located in Hall County,
<br />Nebraska, hereinafter described, and that more than two years have elapsed since her death, and
<br />that no application has been made in the state of Nebraska for the appointment of an administrate
<br />of her estate,, and no petition filed therefor, and no administration has been had upon her
<br />said estate in the state of Nebraska.
<br />The Court further finds that the said Gertrude Willer left surviving her as her heirs at law
<br />and her only heirs at law, Heinrich Willer, Julius Willer, Hans biller, Carl Willer, Nichlous
