<br />Now, on t1lie 21st day of November,1919, this cause came on for hearing upon the petition of
<br />Augusta Hintz, the widow of the said Fritz J. T.Hintz, Deceased, praying for the settlement of
<br />the estate of said deceased, 4 determination of his heirs and the right of descent of his real
<br />property and the degree of kinship of said heirs at law, and it appearing from the proof on file
<br />herein that due and legal notice by publica► ion for three successive weeks, as by law and the
<br />order of this court required, h"d been given to all creditors, theirs at law, and persons inter-
<br />ested in si-.id estate, of the filing of said petition and of the time and place for hearing the
<br />same, which time was more than thirty days and less than sixty days after the filing of 84id
<br />petition, and there being no objections made thereto, the said cause was duly submitted to the
<br />court upon the petition, and the evidence of the petitioner in support thereof, and the court
<br />being fully advised in the premises finds that the allegations of said petition are true, that
<br />said Fritz J,.T.Hintz died intestate in Grand Island, Nebraska, on August 22,1916,. and that at
<br />the time of his death he was a resident of Hall County, Nebraska; that he died seized of an
<br />estate of inheritance in real estate located in Mall County, Nebraska, as hereinafter stated;
<br />that more than two years have elapsed since his death, and that no application has been made
<br />for the appointment of an administrwtcr of his estate, no petition filed therefor,. and that no
<br />administration has been had of his estate.
<br />The court further finds that said deceased left surviving him as his heirs at law the follow
<br />ing named persons, to -wit: Augusta Hintz, his widow, Ida Jorgensen, his daughter, Alvin& - Schmidt'
<br />hits daughter, Ella Wiese, his daughter, Daniel Hintz, his son, Bertha Rhoda, his daughter, Fred
<br />Hintz, his son, Emma Hintz, his daughter, John Mintz, his son, and William Hintz, his son, and
<br />that all of said heirs at law are more than twenty one years of age.
<br />The court further finds that the said deceased died seized of an estate in fee simple in the
<br />following described real estate situate in hall County, Nebraska,, to-wit:: Lot Two (2) Block One
<br />Hundred Twenty Three (123) of Union Pacific Railway Cole Second Addition to the town, now City
<br />of Grand Island,,Nebraska, which property was occupied by the deceased as a homestead at the
<br />time of his death; that upon his death, said real estate did pass and descend, by operation of
