<br />Now on this 8th day of November, 1919, this cause came on to be heard upon the final report
<br />of Carl H.Menck, administrator of the estate of Christian H.Menck, deceased, notice having been
<br />given to all persons interested by publication as required by law and the order of court. and
<br />no one having appeared to object to the allowance of said report.
<br />On consideration of the report and the evidence in support thereof the Court finds that said
<br />report is correct in all respects and ought to be allowed; that the administrator has accounted
<br />for all of the estate which came into his hands, has paid the costs of administration, the fun-
<br />eral charges, and all debts filed and allowed against said estate and has distributed the persol
<br />property remaining among those entitled to share in the distribution, and that there remains ilo-
<br />money or other property in his hands for distribution.
<br />The court finds that notice was given to all creditors of the time allowed for filing claims
<br />and of the place appointed for the hearing on claims filed, in the manner required by law; that
<br />the time allowed for filing claims has fully expired and that all claims outs&anding against sai
<br />estate and not so filed, if any such there be. are '_'therefore forever barred and excluded.
<br />It is therefore considered by the court that the report of Carl H.Nenck, administrator, be
<br />and the same hereby is approved and allowed as and for his final account and he is discharged of
<br />his trust and his bond released, and;it is further considered by the court that all persons
<br />are forever barred and precluded from filing or setting up any claims or demands against the
<br />estate of Christian H.Menck, deceased, and that said estate is fully settled and closed.
<br />The court finds that the said Christian H.Menck departed this life on the firth day of November.
<br />1909, that he died intestate and that he was at that time a resident of Hall County.Nebraska.
<br />The court finds that the said Christian H.Menck died seized in fee of the following described
<br />real estate situate in the County of Hall and State of Nebraska, to -wit:
<br />The North half of the Southwest Quarter (N* of S.W.11, the Northwest Quarter of the Southeast
<br />Quarter (NW-f of SEA) and the Southeast Quarter of the Soutluwest Quarter (Sa SWJ) all in Section
<br />Fourteen (14). in Township Eleven (11). in Range Nine (9),.and Lot Four (4) in Block One hundred
<br />(100) in Railroad Addition to the Qlty of Grand Islundt
<br />The court finds that the said Christian H.Venek left surviving him as his heirs at law, and
<br />his only heirs at law, the following named persons ::
<br />Tiene Menck, his widow, and John G.Menck, Emilie M.Menck. August C.Mer_ck and Carl H.Menck, hie
<br />children, and that the said Tien& Menck was the mother of all of the chi-ldren of said deceased..
<br />The court (Ands that under the provisions of the law of descent of the State of Nebraska
<br />all of the above mentioned and described real estate did pass and descend at the death of the
<br />said Christian H.Menck,_ intestate, in the manner following:
<br />To Tiene Menck, one third part thereof in absolute title; To John G.Menek, Emilie M.Menck, August
<br />C.Menck and Carl H.Menck, two - thirds part of said real estatis in absolute title subject only to
<br />the homestead rights of the said Tiene Menck therein.
<br />It is therefore considered by the court that all of the right, , title and interest of Chbris
<br />H.Menck in and to the North * of tho Southwest Quarter,the Northwest * of the Southeast -J and
<br />the southeast J of the Southwest -' of Section 14, in Township 11, in Range 9, and Lot 4 in Blo
<br />100 in Railroad Addition to the City of Grand Island, all in Hall County, Nebraska, did descend
<br />at the death of the,--.said Christian H.Menck, intestate, in the following manner:
