BOWEN, DECEASED <br />Now on this 22nd day of May, 1919, that being the day fixed by the former order of this C <br />for a hearing upon the petition of Maud Bowen Baker, nee Bowen, heretofore filed in this cause <br />on the 16th day of April,1919, said cause came on for hearing and upon consideration of the re-!j <br />cord and the evidence the Court finds, that due and legal service of the hearing upon this petiion <br />has been duly had by publication in manner and form as ordered by the Court and as provided by <br />law. <br />Whereupon said cause came on further to be heard and upon consideration of the record and t <br />evidence, the Court finds: <br />That upon the 16th day of April, 1919, Maud Bowen Baker, nee Bowen, filed her duly verified] <br />petition in this Court, praying among other things that the Court fix a time and place for a <br />hearing upon said petition, and there apon said hearing it be 'ordered by decree of this Court, <br />the time of the death of Samantha Bowen, deceased, a decree of the heirs of said deceased and <br />decree 41nship and the right of descent of said real estate belonging to the said deceased <br />at the time of her death, and that said real estate descended free and clear of all debts <br />against said estate.. And the Court further finds that thereafter and upon said 16th day of April,, <br />19198 this Court made and entered an by order fixing this day and hour as the time -'or heari <br />upon said petition and ordered that notice of said hearing be given by publication of a notice <br />thereof for three consecutive weeks in the North Platte Tribune, a legal weekly newspaper print <br />and published and of general circulation in Line4ln County, Nebraska, and the Court finds that <br />said notice hap been duly given and that the Court now has jurisdiction of all parties interest <br />in this matter and has jurisdiction of the subject matter thereof*. <br />Whereupon said cause came on further to be heard, and upon consideration of the record and <br />evidence, the Court finds: <br />1. That Maud Bowen Baker, nee Bowen, is the fee simple title owner of an undivided one -half In- <br />terest in and to all of the following described real estate, towit: Lots numbered 11 and 12 in <br />Block number 21, in the original town of Wood River, State of Nebraska, also an undivided one - <br />half interest in the SE1 of NE" and the NXJ of the SE-11, of Section 17, Township 10, North of <br />Range 11 West of the 6th P.M. in Hail County, Nebraska. <br />?,..That Samantha Bowen late of the County of Lincoln and State of Nebraska, departed this <br />life at North Platte in Lincoln County, Nebraska, on the 24th day of March 1913, being at the <br />time of her death a resident and inhabitant of said County of Lincoln and State of Nebraska. <br />3• • That Samantha Bowen at the time of her death was the fee simple title owner of all of the <br />above described real estate and that said real estate is of the value of about 416,000.00. <br />4.. That the petitioner, Maud Bowen Baker, nee Bowen obtained her title to said real estate <br />by inher -itance from the said Samantha Bowen, who was the mother of the petitioner herein, and <br />Jerry Bowen, who was the father of the petitioner herein,, <br />5. That more than two years have elapsed since the death of the said Samantha Bowen and that <br />the said Samantha Bowen died intestate a resident and inhabitant of Lincoln County,Nebraska, <br />and that said deceased during her life time and at the time of her death was seized of an esta <br />of inheritance in the real estate' heretofore described.. <br />6. That no application has ever been made in the State of Nebraska for the appointment of an <br />administrator of the estate of Samantha Bowen eigher by her heirs or by persons claiming to <br />be creditors of suid.wdeceased, and that no administrator has ever been applied for or appointed <br />in the State of Nebraska. <br />i <br />1 <br />D <br />n <br />1 <br />
