<br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA.

<br />John G.Menck, Deceased.
<br />Now on this 12th day.of August, 1919, this cause came on for hearing upon the petition of Lent
<br />Menck, widow, of John G.Menck, deceased, praying for a decree determining the death, the heirs at
<br />law of said deceased, the degree of kinship of said heirs and the right of his real estate, and
<br />i
<br />it appearing to the court from the proof on file that due and legal notice has been given to all
<br />persons interested both creditors and heirs at law, by publication for three successive weeks,
<br />required by, law and the order of this court, of the filing of said petition and of the time and
<br />place fixed for the hearing, which time was more than thirty days and less than sixty days after
<br />the filing of said petition, and no objection or protest having been made or filed thereto, said
<br />cause was submitted to the court upon the petition and the evidence of the petitioner in its
<br />support. The court being fully advised in the premises finds that the allegations in said petiti
<br />are true, that said John G.Menck died intestate in McLean County, Illinois, on the 27th_4ay of
<br />March, 1910, being the time of his death a resident and inhabitant of said County and State, a
<br />that he died seized of an estate of inheritance in Hall County.Nebraska, and that more than two
<br />years have elapsed since his death and that no application has been made in the State of Nebrask
<br />I,
<br />for the appointment of an administrator for his estate and that there has been no administration
<br />of his estate.
<br />The court further finds that the said John G.Menck left surviving him as his heirs at law and
<br />his only heirs at law, the following named persons: Lena Menok, his widow, Henry J.Menck, his so #,
<br />Mildred D.Knight, nee Menck, his daughter, Agnes E.Nelson, nee Menck, his daughter, Harry C.Menc#,
<br />his son, Eleanor M.Wade, nee Menck, his daughter, Erma Menck, his daughter, Lloyd C.Menck, his s
<br />and Herman G.Menck, his son; that the said Lloyd C.Menck and Herman G. Menck are minors and thati
<br />all of the other named heirs are above the age of twenty -one years; that Lena Menck, his widow,
<br />is not the mother of all of the children of said John G.Menck, deceased.
<br />The court finds that the said John G.Menck died seized in fee of an estate of inheritance in
<br />Hall County, Nebraska, being an undivided one- fourth interest in the following described real
<br />estate situate in the County of Hall and State of Nebraska, to -wit:
<br />All of the North half (Nei) of the South -west quarter (SW) and the South -east Quarter {SEA} of
<br />the South -west quarter (SW�) and the North -west quarter (NW -J) of the South -east quarter (SEA)
<br />of Section Fourteen (14) in Township Eleven (11), north. of Range Nine (9), west, of the 6th
<br />P.M., except three strips of ground described as follows:

<br />A strip of ground One Hundred (100) feet wide across the north half (N **) of the South -west
<br />quarter (S.W.i) of said Section 14, it being fifty feet on each side of the center line of the
<br />railroad of the Chicago, Burlington and Quincy Railroad Company as same is now located and con-
<br />structed upon the North half (NJ) of the South -west quarter (SWJ) of said Section 14, and a stri
<br />of ground One Hundred and Fifty (150) feet wide across the South -east quarter (SE +) of-the Soutr

<br />west quarter (SWI) of said Section 14, it being fifty feet wide on the Xorth side and One hundre
<br />E feet wide on the South side of the center line of the railroad of the Chicago, Burlington and
<br />j Quincy Railroad Company as same is now located and constructed across said South -east quarter
<br />(SEi-) of the South -west quarter (SW-J) of said Section 14, and a strip of ground commencing at
<br />a point Two rods south of the North -west corwer of the South -west quarter (Sw�) of said Section

<br />Section 14, thence east 80 rods to the North east corner of the northwest quarter (NWi) of the
