<br />appearing to the court that the defendants herein had been duly notified of the filing qnd pend-
<br />envy of this action by publication for the time and in the manner as by law provided, it is orde
<br />ed that their default be entered herein and that the facts stated in the plaintiff's petition
<br />be taken as true as against them and each of them.
<br />This cause coming on further for hearing was submitted to the court upon the pleadings and
<br />the evidence, tâ–ºpon consideration whereof, the court finds that Robert H.Brown, Plaintiff herein
<br />under and by virtue of a warranty deed therefor from Eliza Isabella Miller and B.N.Mi.11er, her
<br />husband, dated April 9,19190 became the owner and took actual possession of Lot Six (6), in
<br />Block Ten (10), in John Voitle's Addition to Grand Island,Hall County,Nebraska; that said warr-
<br />arty deed was filed for record on the 29th day of May, 1919, and recorded in Book 56, at Page
<br />531, of the Records of the office of the Register of Deeds of Hall County,Mebraska.
<br />The Court further finds that there is some doubt and uncertainty respecting the title to said
<br />premises, growlkng,_ out of the confused, complex and disorderly spelling of the defendants names
<br />in connection with the record title of said premises and that by reason thereof there is a
<br />cloud upon said title.
<br />The Court further finds that Robert H.Brown, plaintiff herein, and his immediate grantors
<br />above named have been in the actual, open, notorious, continuous, exclusive and adverse possess-
<br />ion of said premises under claim of title and ownership for more than ten years immediately
<br />prior to filing of the petition herein, and that, the defendants herein or neither of them have
<br />any right or title to, lien or claim upon, or other interest in the above described premises,
<br />and that the title to said__premises should be quieted and confirmed in the plaintiff herein.
<br />It is therefore, ordered, adjudged and decreed by the Court that the defendants herein, or
<br />neither of them, have any right or title,to, lien or claim upon, or other interest in Lot Six
<br />(6), in Block Ten (10), in John Voitle's Addition to Grand Isl.and,Hall County.Nebraska; that
<br />said defendants, and each of them, and all persons clalming by, through or under them are here-
<br />by forever barred, excluded and enjoined from asserting or claiming any right : jf title to, lien
<br />or claim upon, or other interest in said premises; and the title to the above described premises
<br />is hereby quieted and confirmed in Robert H.Brown, plaintiff herein.
<br />It is further considered by the Court that the plaintiff pay the costs of this action, taxed
