<br />raska, on October 16,1905, and that at the'time of her death she was a resident and inhabitant
<br />�of said Hall County,Nebraska, and died seized of an estate of inhereitance in real estate located
<br />in :all County, Nebraska, as hereinafter stated; that more than two years have elapsed since her
<br />death, and that no application has been made in the state of Nebraska for the appointment of an
<br />administrator of her estate, no petition filed therefor, and that no administration has been had
<br />of her said estate..
<br />The Court further finds that the said deceased left surviving her as her only heirs at law the
<br />following named persons: Charles E.Bly, her husband, and Guy Bly, and Perry M.Bly, her children,
<br />all of Wood River,Hall County,Nebruska, and that all of said heirs at law are more than twenty-
<br />one years of age, and that she left no other heirs at law exoept as above stated, and that their
<br />degrees of kinship to her were as above stated,viz., surviving husband and children.
<br />The Court further finds that the said deceased died seized in fee simple (being an estate of
<br />inheritance) of the following described real estate situate in Mall County,Nebraska, to -wit: The
<br />north half of the southwest quarter of Section Number Fifteen (15), in Township Number Ten (10),
<br />North, '.range Number Eleven (11) West, subject to the right of way of the Union Pacific Railroad
<br />over same, which real estate did, on the death of the said deceased, pass and descend, by operati
<br />of law, in fee simple to the said Guy Lly and Perry He Bly, as tenants in common, one -half part
<br />to each, subject, however, to the homestead rights and curtesy rights of the said Charles R.Bly,
<br />surviving husband of said deceased, for and during his natural lifetime and as provided by the
<br />law of descent in the state of Nebraska then in force.
<br />The Court further finds that no petition or application has been filed in the state of Nebra.sl
<br />for the appointment of an administrator of the estate of said deceased; that no administration
<br />has been had upon her estate in said state of Nebraska; that she died intestate, and that more
<br />than two years have passed since her death, and that her funeral expenses have been fully paid,
<br />and that all debts of said deceased and of her estate, if any exist, are forever barred and pre-
<br />cluded, and that the cost of these preceedings have been fully paid, and that said petitioners ai
<br />qualified to file said petition for the purposes therein set forth.
<br />IT IS THER*FFORF BY THE COURT ADJUDGED, COZ SIDFRED, A21D DECREED that the said deceased died in-
<br />testate more than two years prior to the filing of said petition in thiip cause; that no applica-
<br />tion for the appointment of an administrator of-her estate has been made, nor has any administra-
<br />tion been had upon her estate, in the state of Nebraska; that she died seized in fee simple of an
<br />estate of inheritance situate in Iall County,Nebraska, as above described, and set forth; that
<br />she left surviving her as her only heirs at law the above named persons, who bore the degree of
<br />kinship to her as her surviving husband and children; that the above described real estate passed
<br />and descended to Guy Bly and Perry Y.Bly, her sons, in equal shares as tenants in common, subject
<br />to an estate of curtesy and homestead therein which passed and descended to her surviving husband
<br />Charles E.Bly, for and during his lifetime, and to their respective heirs and assigns forever, as
<br />provided by the law of descent then in _once in the state of Nebraska, and that the same is here-
<br />by so awarded to -them; that all debts of said deceased and her estate, if any exist, are forever
<br />barred and precluded, and all. further administration of her estate is hereby dispensed with and
<br />said estate is settled and forever closed.
