<br />perty of whatsoever kind and nature, including the east half of the southeast quarter and the
<br />acre, more or less, owned by me in the southeast corner of the west half of the south east quarter,
<br />of section thirty-two, township nine, range eleven, in Hall County, Nebraska, to my daughter,.
<br />Anna Susanna Donner Lovewell.
<br />ITEM.I hereby nominate and appoint my said wife, Rosa Donner, sole executor of this will, and
<br />direct that she be not required to give any bond.
<br />ITEM. In case my said wife, Rosa Donner, should for any reason fail to assume the duties of
<br />executor of this will, then I nominate and appoint Jacob Ruhter, of Adams County, Nebraska, ex-
<br />ecutor of this will.
<br />Memo. I hereby request my daughter, Anna Susanna Donner Lovewell, to pay to my other children
<br />the several sums of money as follows: To my son, Gustaf Adolph Donner, two .hundred dollars;
<br />To my son, August Donner, five dollars;
<br />To my son, John Donner, five dollars;
<br />To my daughter, 011ie Donner, five dollars;
<br />To my daughter, Augusta Donner, five dollars;
<br />To my son, Fred Donner five dollars;
<br />it being my wish that such payments be made upon the death of my wife, Rosa Donner, in case she
<br />survives me; otherwise upon my own death. But such payments to my other children are to be made
<br />voluntarily by my daughter Anna Susanna Donner Lovewell, and are not in any way to affect or in-
<br />cumber the proitisions made in this Will for my said daughter Anna Susanna Donner Lovewell.

<br />We, whose names are hereunto subscribed, do hereby certify that Fred Donner, the testator,
<br />subscribed his name tot this instrument, in our presence and in the presence of each of us, and
<br />declared at the same time in our presence and hearing that this instrument was his last will
<br />and testament, and we at the request of said testator signed our names hereto in his presence
<br />and in the presence of each other as witnesses to said instrument.

<br />15.The Court further finds that by the terms of said Last Will and Testament, Rosa Donner,
<br />widow is cr_titled to the use of all the real estate of which the said Fred Donner died seized
<br />during her natural life, and at her death the fee in all of the said property to go to Anna
<br />Susanna Donner Lovewell with the suggestion to the said Anna Susanna Donner Lovewell that she
<br />pay to said Gustaf Adolph Donner Two hundred Dollars; to August Donner Five Dollars; to John
<br />Donner Five Dollars; to 011ie Donner Five Dollars; to Augusta Donner Five Dollars and to Fred
<br />Donner Five Dollars; that the said Rosa Donner, widow, is also entitled to the personal prope
<br />belonging to said estate in accordance with the terms of said Last Will and Testament as constried
<br />by this Court under the Law.
<br />16.T hat the said Jacob Ruhter submitted his account and vouchers and no one appearing to objoo t
<br />thereto or contest the same, the Court finds that said account is ,just and true and should be
<br />allowed and ordered recorded as his final account.
<br />17.The Court further finds that the said Jacob Ruhter, executor aforesaid, has fully accour .
<br />for all property -_c>r:ing into his - ossession or knowledge belonging to said estate; has faithfull
<br />and impartially administered his said trust in accordance to law, the orders of the Court and
<br />the terms of said last Will and Testament, and that upon his filing voucher showing that he has
<br />paid to Rosa Donner, widow, the sum of $75.51, he be discharged from his said trust.
<br />IT IS TH.RRFFORE CO TSIDERED, ADJUDGED AND ORDERED by the Court that said account of Jacob
<br />Ruhter, executor, be and the same is hereby ap, roved, confirmed, allowed and ordered recorded al
<br />his final account and that upon his filing voucher showing the payment of 075.51 to Rosa Donner
<br />widow, he be discharged from his said trust.
