<br />9.T hat on the first day of April, 1913, the Court made an order fixing the 26th day of April,
<br />1913, at 10 o'clock A.M. at the County Court Room. in Hastings, Nebraska, as the time and place
<br />for the filing, examination and adjustment of claims against said estate, and directed that all
<br />!claims not filed on said day, so limited, or within six months thereafter, should be forever barred,
<br />and further directed that notice of such order should be given by the publication of a copy of
<br />said order in the Hastings Tribune, a newspaper.printed, published and of general circulation in
<br />said county for four weeks prior to said day of hearing.
<br />10 -That notice was given by the publication of a copy of said order in the Hastings Tribune,
<br />as directed, and that proof of the due publication thereof was filed with this Court on the 26th
<br />day of April, 1913.
<br />11-That the time limited for the filing, examination and adjustment of claims against said
<br />estate has long since expired,and that all claims filed and allowed have been fully paid, in-
<br />cluding costs of administration; that all claims not filed have become barred by the Statue
<br />of Limitation, and that there are no appeals pending from the disallowance-of any claim,.and
<br />that there regains in the hands of the said executor the sum of $75.51.
<br />12.That the said Fred Donner, died seized of the following described real estate to -wit : -
<br />The East half (ED of the southeast quarter (SRI) of section thirty-two (32),township nine
<br />(9), North, Range eleven (11). West of the Sixth P.M.Hall County, Nebraska, being 80 acres more
<br />or less,
<br />Also one acre in the southeast corner of the west half (WY) of the southeast quarter (SE-41)
<br />of section thirty -two (32), township nine (9), North, Mange eleven (11). West of the Sixth P.M.
<br />Hall County, Nebraska.
<br />13•That the said Fred Donner left surviving him as his only heirs at law the following named
<br />persons, legatees and devisees under the Will, to -wit:
<br />Rosa Donner, widow.
<br />Anna Susanna Donner Lovewell, daughter,
<br />Gustaf Adolph Donner, son,
<br />August Donner, son,
<br />.Tohn Donner, son,
<br />011ie Donner, daughter,
<br />Augusta Donner, daughter,
<br />Fred Donner, son.
<br />All being of legal age.
<br />14.That the last Will and Testament of the said Fred Donner is in words and figures as foll-
<br />4 oters, to-wit:-
<br />"IN TIM NAME OF GOD,AHEN, I, Fred Donner, of the County of Adams and State of Nebraska, being
<br />of sound mind, -memory and understanding, do hereby make and publish this my last will and Testa-
<br />went, hereby revoking and making void all former wills by me made at any time heretofore.
<br />ITEM. And as to my wordly estate, and all of the property, real personal or mixed, of which
<br />I shall die seized and possessed , or to which I shall be entitled at the time of my decease.
<br />I devise, bequeath and dispose thereof, in the manner following, to -wit:
<br />ITEM -My Will is, that all my just debts and funeral expenses shall, by my executor hereinafter
<br />named, be paid out of my estate. as soon after my decease as shall by my executor be found conven-
<br />ient,
<br />ZTEV*I give and bequeath to my beloved wife, Rosa Donner, all of the property of every kind
<br />and nature of which I may die seized and possessed, to her use during her natural life.
<br />ITEM.At the death of my beloved wife, Rosa Donner, I give, devise and bequeath all of my pro-
