The <br />City of Hastings, County of Adams And State of Nebraska. <br />Present: William F. Button, Judge of the County Court. <br />In the Matter of the Estate <br />DECREE OF FINAL ACCOUNT <br />of <br />AND <br />Fred Donner, Deceased., <br />DISTRIBUTION OF ESTATE <br />Now on this 9th day of December, 1913, this cause came on to be heard upon the petition of <br />Jacob Ruhter, executor of the Last Will and Testament of Fred Donner, deceased, praying for the <br />examination and allowance of his account, and for his discharge as such executor, and is sub - <br />mitted to the Court, upon consideration whereof, the Court finds from the records, the proofs <br />on file, and the evidence:- <br />1 That on the 20th day of November, 1913, the Court made an order fixing the 9th day of Dee- <br />ember, 1913, at 10 o'clock A.M. at the County Court Room in Hastings. Nebraska,as the time and <br />place for the examination of said account and hearing on said petition, and directed that notice <br />be given by the publication of a copy of said order in the Hastings Tribune, a newspaper printed, <br />published and of general circulation in said county for three weeks prior to said day of hearing. <br />2 That notice was given by the publication of a copy of said order in the Hastings Tribune, aE <br />directed, and that proof of the due publication thereof was filed with this Court on the 9th day <br />of December, 1913, <br />3.The Court further finds that said Fred Donner departed this life, testate, on the 27th day <br />of February, 1913, at his home in Adams County, Nebraska, being at the time of his death and <br />for a long time prior thereto a resident and inhabitant of said County and State. <br />4.That on the 5th day of March, 1913, Anna S. Lovewell by her attorney, John C. Stevens, filet <br />in this Court a paper writing purporting to be the last Will arbd Testament of Fred Donner, de- <br />ceased. also filed. her petition praying that said paper writing might be probated and allowed <br />as the Last Will and Testament of said Fred Donner, deceased, and that Letters Testamentary mighl <br />issue to Jacob Ruhter as executor thereof. <br />5.That on said day the Court made an order fixing the first day of April, 1913, at 10 o'clock <br />A.M. at the County Court Room in Hastings, Nebraska, as the time and place for the hearing on <br />said petition, and directed that notice be given by the publication of a copy of said order in <br />the Hastings'Tribune, a newspaper printed, published and of general circulation in said county <br />for three weeks prior to said day of hearing. <br />6.T hat notice was given by the publication of a copy of said order in the Hastings Tribune, <br />as directed, and that proof of the due publication thereof was filed with this Court on the 21st <br />day of March, 1913. <br />7.That on the first day of April, 1913, hearing was had, proofs taken and a decree of probate <br />duly executed, proving approving, probating and allowing said instrument as the Last Will and <br />Testament of Fred Donner, deceased, and directed that Letters Testamentary should issue to Jacob <br />Ruhter upon his filing bond in the sum of $1000.00 with sureties to be approved by the Court, <br />and taking and filing the oath required by law; the said Rosa Donner, widow, having relinquished <br />her right to act as executrix. <br />8.T hat on said day the said Jacob Ruhter duly qualified by filing bond, with surety, which <br />was approved by the Court, and taking and filing oath required by l -aw, and thereupon Letters <br />Testamentary were duly issued to him and he entered upon the discharge of his duties as such <br />1 <br />1 <br />1 <br />1 <br />1 <br />
