<br />The court finds that under the provisions of said last Will and Testament, all of the above
<br />mentioned and described real estate did pass and descend at his death to Paulina Peters, his
<br />widow, to have and to hold the same during the period of her natural life, but with full power

<br />j and authority to sell and convey all or any part or portion thereof at any time she may desire
<br />I
<br />to do so.
<br />The court finds that at the death of the said Paulina Peters all that part of said real estate
<br />remaining undisposed of by the said Paulina Peters during her life time, descends to and becomes
<br />the property of Albert Peters and Johanna Peters Thom, share and share alike, under the terms
<br />and -provisions of said last Will and Testament.
<br />The court finds that under the provisions of the last Will and Testament of the said John
<br />Peters, deceased, all of the personal property left -by the testator Lt the time of his death
<br />passed and became the property of the said Paulina Peters for and during the time of her natural
<br />life, - any part of the same remaining at her death to pass to the said Albert Peters and Jo-
<br />` hanna Peters Thom in equal shares.
<br />It is, therefore, considered and adjudged by the court that the South Half of the North West
<br />Quarter and the North East Quarter of the North West Quarter of Section 26, in Township 13, in

<br />Range 9, in Howard County, Nebraska, - the South Half of the South East Quarter of Section 34
<br />in Township 13 in Range 9, in Howard County, Nebraska, and Lots 5 and 6 in Block 132 of Koenig
<br />& Wiebe's Addition Lo the City of Grand Island, in Hall County, Nebraska, did, under the terms
<br />and provisions of the last Will and Testament of John Peters, deceased, pass and descend at the

<br />!death of the said John Peters, to Paulina Peters, his widow, to have and to hold to her for her
<br />use and benefit for and during the term of her natural life with full plower to sell and convey
<br />fall or any,part of -said real estate, and to use the _, -)roceeds therefrom as she may see fit, and

<br />that after her death all of said real estate, as well as the personal property remaining, passes

<br />IN THE NA71,M OF GOD, AIMN: I, John Peters, of the County of Hall and State of Nebraska, being
<br />of sound mind and memory, do hereby make, publish and declare 'this my last Will and Testament
<br />in words and figures following:
<br />1. I give and devise unto my beloved wife Paulina Peters all of my property, both real and
<br />personal, of every description that I may own at the time of my death, to have and to hold the
<br />same during the period of her natural life, but with full power and authority to sell and con-
<br />vey all or any part or „ortion thereof at any time she may desire to do so, and she shall have
<br />authority to sell all or any part of the same, either real or personal property, z.nd use Lhe
<br />proceeds for any purpose she may see fit. Any part of said property, either real or personal
<br />that remains undisposed of by my wife during her lifetime shall become a part of my residuary
<br />estate and shall pass as hereinafter provided.
<br />2. I give and bequeath unto nW :wife Paulina peters, all of my household furniture, jewelry,
<br />clothing, and personal effects to have and to hold for her and her heirs forever.
<br />3•, Upon the death of my wife, or should she precede me in death, then upon my death, all the
<br />residue and remainder of my said estate, including uny - ;portion of the property mentioned in
<br />paragraph (1) which may not have been sold, shall be equally divided between my two ch?ldren
<br />Albert Peters and ; lohanna Peters Thom, share and share alike, and should they or either of them
<br />precede me or my wife in death, then to their issue by right of representation, to have and to
<br />hold to them and their 11eirs i orever.
