<br />of his right, title and interest in the above mentioned and described real estate, did pass and
<br />descend in the manner following:
<br />To Mary A. Hargis, one -third part thereof in fee simple; to Alma Rickard, Amanda J. Nelson
<br />and Louisa E. Mackan, two- thirds part thereof, being two - ninths part of said real estate to
<br />each of said daughters, in fee simple, subject however to the homestead right of Mary A. Hargis,
<br />the widow, in and to said real estate.
<br />The court finds that all of the legal heirs of said Fountain Hargis, deceased, have entered
<br />into an agreement and stipulation under the terms and provisions of which the said Alma Rickard,
<br />Amand J. Nelson and Louisa E. Mackan and their husbands, have assigned and set over to Mary A.

<br />Hargis, widow, of Fountain Hargis, all of their right, title and interest in the above mentioned
<br />and described real estate and in all of the personal property belonging to said deceased and
<br />now held by the administratrix for the use and benefit of said Awry A. Hargis, for and during
<br />the term of her natural life, and that the said Awry A. Hargis by the terms of said stipulation
<br />and agreement agrees to and has accepted the aforesaid assignment of real estate and personal
<br />property to her during her natural life, and remises, releases and quit claims any other further
<br />or different rights which she may have in and to any part or portion of said estate of Fountain
<br />Hargis, deceased, either real or personal.
<br />The court finds further that under the provisions of said agreement and stipulations entered
<br />into among the heirs of the said Fountain Hargis, deceased, that all of the above mentioned and
<br />described real estate is to descend at the death of said Mary A. Hargis and vest in fee simple
<br />to said Alma Rickard, Amanda J. Nelson and Louisa E. Mackan, share and share alike and that all
<br />of the per.sonaly property belonging to said estate remaining at the death of said Awry A. Hargis
<br />in money, notes and mortgages, and personal property or any other kind or description shall be
<br />divided equally share and share alike to the said Alma Rickard, Amanda J. Nelson and Louisa E.
<br />Mackan, or the survivors of them.
<br />The court finds that by virtue of the provisions of the agreement and stipulations entered
<br />into by and among the heirs of Fountain Hargis, deceased, all of the notes and mortgages belongin�
<br />to the estate should be assigned by the administratrix to Mary A. Hargis.
<br />The court finds from the examination of the files and records that the estate of Fountain
<br />Hargis, deceased, is solvent, that there are no debts outstanding against said estate, and that
<br />the administratrix should, therefore, be allowed a reasonable sum for the erecting of a mon-
<br />ument at the grave of said deceased.
<br />It is therefore, by the court ordered that said Mary A. Hargis, administratrix, be and she
<br />hereby is authorized to erect a monument as prayed for in her final report.
<br />The aforementioned agreement and stipulation of heirs of Fountain Hargis, deceased, was filed

<br />j in this office and a copy of same is attached to this decree and filed for record in the office
<br />j of the Register of Deeds, of Hall County, Nebraska.

<br />KNOW ALL ION BY THESE PRESENTS that whereas Fountain Hargis, of the city of Grand Island, County
<br />of Hall and State of Nebraska, departed this life in said city on the 5th day of September. A.D.
<br />1915, and left surviving him as his heirs at law and only heirs, Lary A. Hargis,.the widow of
<br />said deceased, Alma Rickard, of Hall County, Nebraska, (born Hargis), Amanda J. Nelson of Hall
<br />County, Nebraska, (born Hargis) and Louisa E. Mackan of Baker County, State of Oregon, (born Har-
<br />gis) and Leonard K. Rickard of Hall County, Nebraska, husband of the aforesaid Alma Rickard,
<br />Sylvester M. Nelson, husband of the aforesaid Amanda J. Nelson, and James L. Mackan, husband
<br />i of the aforesaid Louisa B.- Mackan, they being all the heirs, and persons interested in the estate
<br />of the said Fountain Hargis, deceased. It being agreed among said parties and to and by each of
<br />them that the debts if any, of any kind or nature whatsoever against said estate be ?paid and
