Hargis, administratrix of the estate of Fountain Hargis, deceased, it appearing to the ' <br />satisfaction of the court that notice of the filing of said rep©rt and of the time and place <br />i <br />I <br />fixed for final settlement of said estate has been given to all persons interested by publication <br />of such notice for one week prior to the 27th day of January, 1917, in the Grand Island Independ <br />ent, as required by order of court dated January 15, 1917. <br />I <br />On consideration of said report and of the files and records in this estate, the court finds <br />that the report is correct in all respect and ought to be allowed. <br />The court finds that notice was given to all creditors of the time allowed and place appointed <br />for filing claims against the estate of Fountain Ha�rgis, deceased; that the time limited for fil� <br />i <br />ing claims was six months from the 25th day of October, 1915, and that said time has long since <br />expired; that all claims filed and allowed against the estate of said deceased have been fully <br />paid and satisfied. <br />The court further finds that all claims or demands outstanding against the estate of said <br />Fountain Hargis, deceased, and not so filed within the time allowed for filing claims, if any <br />such there be, are therefore, forever barred. <br />It is, therefore, considered by the court that all persons are forever barred, excluded and <br />precluded from filing or setting up any claims or demands against the estate of Fountain Hargis, <br />deceased, and that said estate is fully settled and closed. <br />It is further considered that the report of Mary A. Hargis, administratrix, be and the same <br />hereby is approved and allowed as and for her final account, and she is discharged of her trust' <br />and her bond released. <br />The court finds that Fountain Hargis departed this life on the 5th day of September, 1915, <br />being at the time of his death a resident of Hall County, Nebraska, and that he died intestate. <br />The court finds that the said Fountain Hargis left surviving him as his heirs at law, and his <br />only heirs at law, the following named persons: Mary A. Hargis, his widow; Alma Rickard. (born ;I <br />I <br />Hargis); Amanda J. Nelson, (born Hargis); and Louisa E. Mackan, (born Hargis), his daughters. <br />The court finds that the said Fountain Hargis died seized and possessed of the following des- <br />. cribed real estate, situate in the County of Hall, and State of Nebraska, to -wit: <br />The Northerly one hundred and two and one -half (102J) feet of lot number one, (1), in block <br />number fifty-nine (59) in the original town, now city, of Grand Island, Nebraska. The same <br />being a rectangular piece of ground having 102J feet fronting on Cedar Street in said City by <br />sixty -six (66) feet in depth off of the Northerly end of said lot. <br />That the same was the home and homestead of her husband and herself at the time of his death <br />and continuously occupied during several years immediately prior thereto. <br />The court finds that under the provisions of the law of descent of the State of Nebraska, the <br />above mentioned and described real estate did pass and descend at the death of Fountain Hargis, <br />intestate, in the manner following: <br />To Mary A. Hargis, his widow, one -third part thereof in absolute title. <br />To Alma Rickard, Amanda J. Nelson and Louisa B. Mackan, his daughters, the remaining two- thi3�lis <br />part thereof in absolute title, subject however, to the homestead right of the said Mary A.
