<br />It is therefore considered by the court that all persons are forever barred from filing or
<br />setting up any claims or demands against the estate of Minnie Be Downes, deceased, and that said
<br />estate is settled and closed.
<br />The court finds that the said Minnie Be Downes departed this life on the 22nd day of August,
<br />1918, being at the time of her death a resident of Hall County, Nebraska., and that she left a
<br />last will and testament which instrumeitt: vas allowed and admitted to probate in this court on the
<br />21st day of September, 1918, and recorded in this office.
<br />The court finds that the said ydinnie Be Downes died seized in fee of the following described
<br />real P,stq;te situated in the County of Hall and State of Nebraska, to -wit: Lot One (1), in Block
<br />Twenty-six in Russel Wheeler's Addition to Grand Island, and Lot Five (5), in Block Fifteen (15),
<br />in Robin's Addition to the City of Grand Island.
<br />The court finds that under the terms and provisions of the Last Will and Testament of said
<br />deceased all of her right, title and interest in and to the above mentioned and described real
<br />estate did pass and descend at her death to her children, namely, Guy W. Powell, Carrie E. Powell-
<br />Bohr, Ervan E. Powell. Myrtle E. Powell, and Ruth E. Powell, in equal shares, an undivided One-
<br />fifth part thereof to each of said legatees.
<br />The court finds that Lot 5 in Block 15, in Rollins Addition to the City of Grand Island, has
<br />been transferred by the legatees under the will to John We. Downes, husband of the testatrix, in
<br />a settlement made by and among the heirs at law of the said Minnie Be _Downes.
<br />It is therefore considered by the court that Lot 1 in Block 26 in Russel Wheeler's Addition
<br />to the City of Grand Island and Lot 5 in Block 15 in Rollins' Ado tion to the City of Grand Is-
<br />land, all in Hall County, Nebraska, did pass to and become the property of Guy W. Powell, Carrie
<br />Ew Powell Bohl, Ervan E. Sowell, Myrtle Be Powell and Ruth E. Powell, at the death of the said
<br />Minnie B. Downes, under and by virtue of the provisions of her last will and testament, in ab-
<br />solute title as tenants in common.
<br />The court finds that the personal property belonging to the testatrix passed under the will
<br />to the above named legatees, and the executor is authorized to distribute the balance in his
<br />hands among said legatees in equal shares, and he authorized to assign the note.of_�Tohn ".W. Downes'.:

<br />The court finds that each of the above named legatees is entitled to receive the sum of
<br />$588.86 from the sum in the hands of the executor for distribution,

<br />for their respective shares of the personal property in his hands for distribution and he is,
<br />therefore, discharged of his trust and his bond released.
