will all as shown b his said report and the records of this court and that his <br />Y p petition for s <br />settlement of said estate should be allowed. <br />-3- <br />It is, Therefore, by the Court, Adjudged, Decreed and Considered that the said final report of <br />said Executor be, and the same is in all things allowed and approved; that all unfiled claims <br />and debts of said estate, if any there be, are forever barred and precluded; that the above de- <br />scribed real estate. of which said deceased died seized, passed, under the provisions of said wil <br />to said Phillip Stoeger, and to his heirs and assigns, subject to the life estate of said widow, <br />Mary Stoeger, therein, which is now terminated, and subject to the lien of $300.00, thereon in <br />said <br />favor ofACharles Kemptar, (now deceased) which lien is now in favor of and payable to the heirs <br />at law of said Charles Kemptar, deceased, in the proportions and as hereinabove found,, and is nol <br />a lien upon said Lots One and Two, in said Block Three, in the Village of Cairo, Hall County, <br />Nebraska, and said real estate is so assigned to pass under the provisions of said will. That sai <br />Executor is hereby directed to disburse, assign and pay over the remainder of the said personal <br />estate and property in his hands, as provided in said will, to the persons and in the amounts <br />hereinabove found and set forth, and to file their receipts therefor in this court; that upon the; <br />filing of said receipts, said estate will be closed, said Executor discharged and his bond release <br />J.111.Mullin <br />County Judge. <br />Now on this 11 day of February,1919, said Executor filed in this Court, receipts from all of the; <br />legatees and persons entitled to receive the balance of the personal estate remaining in his hand <br />as heretofore ordered, and said estate is closed, said Executor discharged and his bond released.1 <br />J.H.Mullin <br />County Judge. <br />LAST WILL AND TESTAMENT- <br />1, John Stoeger, Sr., of Cairo, Hall County,' Nebraska, being of sound mind and disposing memory, <br />do make and publish this my last will and testament as follows: <br />First. <br />It is my will that all my just debts, including the expenses of my last sickness and burial be <br />first paid out of my personal property. <br />Second. <br />I give and devise to my beloved wife Mary Stoeger, for her use and benefit during her natuaral <br />life the homestead property I now own in the village of Cairo. Nebraska, consisting of three town <br />lots and improvements thereon, and in case she does not desire to use same as a home then she is <br />to have and enjoy the rents, issues and profits therefrom during her life, provided however, that <br />she in all.events and under all conditions, pay all legal taxes assessed against same and keep thi <br />improvements thereon in a good state of repair and also keep the buildings insured in some relia- <br />ble company for their reasonable value. I also set aside out of my money, notes and personal prop <br />1, <br />bd. <br />erty, the sum of Two Thousand dollars ($2000.00) which my executor, hereinafter named, is directed, <br />authorized and empowered to keep invested to the best advantage possible, for the benefit of my <br />said wife, the net income therefrom to be paid to her semi - annually during her lifetime. Said <br />money is now represented by notes due to me from my sons John Stoeger Jr. Henry Stoeger, William <br />Stoeger, Adam Stoeger and Phillip Stoeger and it is my desire that they shall not be forced to pa, <br />i.same during the lifetime of my said wife, provided they keep the <br />(2) <br />I <br />interest thereon paid promptly <br />when same is due, and keep said notes renewed and secured to the satisfaction of my said executor <br />hereinafter named. <br />Third. <br />Out of the principal sum of Two thousand dollars set apart for the use of my wife.
