IrATIOa[IT. .COUNTY ka SCUOm fl}, / ►MR#a - <br />It is further considered that all claims not heretofore filed against said estate are forever <br />barred. <br />And it is further considered and adjudged that the North East quarter of the North East <br />quarter and the South Half of the North East quarter of Section Eleven (11), in Township Nine (9), <br />in Range Ten (10), in Hall County, Nebraska, did pass and descend, under the provisions of the <br />Last Will and Testament of the said Charles J.Cole, to Lucinda V.Cole, his widow, provided she <br />remain single, but that in the event of her marriage the said real estate descends to the childre <br />.and widow of the testator in accordance with the terms of the said will. <br />M/P. <br />J. Mullin, <br />County Judge <br />In the name of God, amen: Charles J.Cole of the township of South Platte, in the county of Hall, <br />and State of Nebraska, considering the uncertainty of this mortal life, and being of sound mind <br />and memory, blessed be God for the same, do make and publish this my last will and testament, in <br />manner and form following, that is to say: <br />First. I direct that my funeral charges, the expenses of administering my estate and all my debts <br />be paid out of my personal property. If that be insufficient I authorize my executors, hereafter <br />named, to sell so much of may real estate as may be necessary for that purpose. <br />Second. I give and bequeath to my beloved wife, Lucinda V.Cole all of Property both Personal and <br />Real of every kind and description including my life Insurance Policy She my Wife to pay all my <br />Debts <br />of <br />every <br />kind <br />and description <br />out <br />of my <br />residue <br />Third. <br />I <br />hereby <br />give <br />the custody of <br />my <br />Infant <br />children during their minority and while they remain <br />unmarried to my beloved wife so long as she remains my widow. but if she shall die or marry again <br />.during the infancy of said children then in that case I commit their custody and tuition to my <br />Friend Wm Neal of Hall Co State of Neb. <br />Fourth. In case that my Wife Lucinda V.Cole shall marry again after my death then and in that case <br />my property will then be taken possession of by my executor and divided as follows, one third to <br />Amy wife Lucinda Cole and ballance of all my property to my children equal. share to each one my <br />executor holding shares of minor children <br />Fifth. I appoint my friend Wm Neal executor of this my last will and testament hereby revoking all <br />former wills by me made. <br />I4 witness whereof I have hereunto subscribed my name this 23rd day of January, in the year of our <br />Lord one thousand nineteen hundred and five. <br />Charles J.Cole. <br />We, whose names are hereunto subscribed, do hereby certify that Charles J.Cole the testator, <br />subscribed his name to this instrument in our presence and in the presence of each of us, and dec <br />at the same time in our presence and hearing that this instrument was his last will and testament, <br />;and we at his request sign our names hereto in his presence as attesting witnesses. <br />S .
