<br />Now on this 15th day of March, 1918, this cause came on .to be heard upon the final report of
<br />Herman J. Helmbrecht, Administrator of the estate of the William H. Helmbrecht, deceased.
<br />On consideration of the files, the report and the testimony, the Court finds that notice has
<br />been given to all persons interested of the filing of said report and of the time and place fixed
<br />ob e e t to
<br />for the hearing thereon. and that no one has appeared o nor protest the allowance of the Adminis-
<br />trator's account; the Court finds that the report of the Administrator is correct in all respects
<br />and ought to be allowed; that the said Administrator has received from all sources the sum of
<br />$4851.22 and has paid out and expended for funeral expenses, labor, taxes, monument. Court costs
<br />expenses of administration the sum of $881472, leaving in his possession for distribution, the s
<br />of $3969.50.
<br />IT IS THEREFORE CONSIDRRED BY THE COURT that the report of the Administrator of the estate
<br />William H. Helmbrecht, deceased, be and the same hereby is approved and allowed as and for his fir
<br />al account, and that upon his paying over the balance now in his hands to the persons entitled to
<br />receive ; the same, he be discharged of his trust.
<br />The Court finds that creditors of the said William H. Helmbrecht, deceased, were allowed
<br />four months from the first day of October, 1917,. in which to file their claims in the office of
<br />the County Judge of Hall County, Nebraska, or be forever barred, and that notice of the time al-
<br />lowed and place appointed for filing claims was given to all persons interested by publication
<br />as required by order of Court dated September 10th, 1917; that the time allowed fdr filing claims
<br />has fully expired and that no claims of any nature were filed against said estate, and that all
<br />claims outstanding against said deceased, if any such exist, are therefore forever barred and ex-
<br />cluded.
<br />IT IS THEREFORE CONSIDERED BY THE COURT THAT all persons are forever barred from filing or
<br />setting up any claims or demands against the estate of William H. Helmbrecht, deceased, and that
<br />said estate.is fully closed.
<br />The Court finds that the said William H. Helmbrecht, departed this life on the 5th day of Aug.
<br />ust, 1917, being at the time of his death a resident and inhabitant of Hall County, Nebraska, and
<br />that he died intestate; that he Was a single man and that he left no wife and no child surviving
<br />him and no issue of a deceased child; that his father preceded him in death and that his mother,
<br />Mary Helmbrecht, survives him, and is, under and by virtue of the law of descent of the State of
<br />Nebraska, his sole surviving heir.
<br />The Court finds that the said William H. Helmbrecht died seized in fee of the North One 1167f
<br />(NJ) of the South East Quarter (SRI) Section Two (2) in Township Twelve (12) in Range Ten (10) in
<br />Hall County, Nebraska, and that under the law of descent of the State of Nebraska, all of the
<br />!above mentioned and described real estate did pass and descend at his death to Mary Helmbrecht, hi
<br />mother, in absolute title, and that all of the personal property remaining in the hands of the Ad-
<br />ministrator, passed to and became the property of the said Mary Helmbrecht, and the Administrator
<br />is required to pay to her the balance now in his hands as shown by his report and to file her re-
<br />ceipt therefore in this Court.
<br />IT IS THEREFORE CONSIDERED BY THE COURT that the North Half (Nj) of the South East Quarter
<br />(SEI) Section Two (2) in Township Twelve (12) in Range Ten (10) in Hall County, Nebraska, did
<br />pass and descend at the death of William H. Helmbrecht, intestate, to Mary Helmbrecht, his mother,
<br />in fee.
