<br />The Court finds that the said George J.Eberl departed this life intestate on the 10th day of
<br />May, 1917, being at the time of his death P_ resident of Hall County, Nebraska, and that he left
<br />surviving him as his heirs at law and his only heirs at law the following named persons:
<br />Anna Eberly his widow, Herman Eberl, Joseph Eberl and Julius Eberl his sons.
<br />The Court finds that the said George J.Eberl died seized in fee of the following described
<br />real estate situate in the County of Hall and State of Nebraska, to -wit:
<br />Lot Seven (7) in Block Ten (10) in Rollin' s Addition to the City; of Grand Island, and
<br />Lots Seven and Eight (7 & 8) in Block Four (4) in Windolph's Addition to the City of
<br />Grand Island.
<br />The Court finds that under the law of descent of the State of Nebraska, all of the above mentio
<br />and described real estate did pass and descend at the death of the said George T.Eberl. in the
<br />manner following, to -wit:
<br />To Anna Eberl, his widow, one -third part thereof, in fee; and to Herman Eberl, Joseph Eberl
<br />and Julius Eberl, the remaining two - thirds parts thereof in equal shares, being two - ninths part
<br />thereof to each of said sons, subject however to the homestead right of the said Anna Eberl, ,yin
<br />and to said above described real estate.
<br />IT IS THEREFORE CONSIDERED ATTID AD.TUDGFD BY THE COt?RT that all of the right, title and inter-
<br />est of George J.Eberl, deceased, in and to Lot Seven (7) in Block Ten (10) in Rollin's Addition
<br />to the City of Grand Island, and Lots Seven and Eight (7 & 8) in Block Four (4) in Windolph's Addi
<br />tion to the City of Grand Island, all in Hall County Nebraska, dial pass and descend at the death
<br />of the said George J.Eberl, in the manner following:
<br />To Anna Eberl, his widow, one -third part thereof, in fee; to Herman Eberl, his son, two-
<br />ninths Fart thereof; to Joseph Eberl, his son, two ninths part thereof; and to Julius Eberl, his
<br />son, two- ninths part thereof, the interest of the above named sons being subject, however, to the
<br />homestead right of the said Anna Eberl, in and to said real estate.
