276,- ?a,f,�er the payment of the debts and funeral expenses, and inheritance taxes passes to Emil Bahr, `but that said personal estate is to be held by Apolonia Steinke, as trustee for Emil Bahr, during her life time and at her death to pass to Emil Bahr. That said estate that -shall pass to Emil Bah is chargable with a bequest of One thousand Dollars, ( $441000.00) to be paid to Anna Dahms, at the death of Apolonia Steinke, which sum is a lien on the estate passing to Emil Bahr. T.hb the lands owned by F. Wilhelm Steinke, at his death, to -wit:- _ The Nest half of the Northwest quarter of Section twelve (12) in Township Twelve (12) North, Range( ,Twelve Nest of the sixth principal meridian in Hall County, Nebraska, does not pass under the will] but descends as intestate property, and that the widow Apolonia Steinke, is entitled to an undi- !vided one half interest therein, and his daughter Anna Dahms, is entitled to an undivided one hal , interest therein. The court having heard testimony and having considered the liability of the estate for inher- itance taxes, and Albert B. Tollefsen, County Attorney being present and participating in said hearinE., the court finds that that part of the estate, going to Apolonia Steinke, and Anna Dahms, is not liable for inheritance taxes. That the inheritance of Emil Bahr under the terms of the will is of the value of $12,050.00, at its worth at the death of the said F. Wilhelm Steinke, and that ,under the laws of the State of Nebraska, is chargable with a tax of $482.00, to be paid into the County Treasury of Buffalo County, Nebraska. That said estate is not liable to inheritance taxes under the Federal Statute. The court finds that after paying all of the, costs, taxes and inheritance charges and claims, that there remains in the hands of the executrix the sum of $3743.25, that she is a proper person to hold the same as a trustee during her life time for the benefit of the said Emil Bahr, and than she give a bond as such trustee to the Judge of this court, in the penal sum of $5000.00, for the faithful accounting and duty as such trustee. It is therefore considered by the court, that the said account so filed be and is hereby ap- proved and confirmed, that the said property descend in accordance with the findings herein made. 1 ;That upon filing receipts for the amounts paid out, and for courts costs, and for attorney fee in the sum of $175. oo to Edward P.McDermott, that she be discharged from her trust as such executrix, and that thereafter she holds the funds as trustee under the terms of the will.
