<br />son Ashbel J.Porter, now deceased, shall receive such share of my estate as would under this will
<br />be coming to my said deceased son if he were living at the time of my deoease.
<br />"In case of the death of any of my children before my decease I direct that the share coming to
<br />such child or children so deceased shall be paid to the child or children of any of such deceased
<br />child or children, share and share alike.
<br />"I give, devise and bequeath to my son Charles I.Porter, all of my real estate wheresoever situat-
<br />ed, except that portion thereof above particularly described, subject to the dower interest there-
<br />in to my said wife, in trust for the uses and purposes following, namely: to take and have entire
<br />use, management, and control of the same, with full power to sell, lease, dispose of and convey
<br />by such deeds and written contracts as he shall deem best,and for such price and upon such terms
<br />as he shall deem most advantageous to my said children, for the purpose of raising any and all
<br />such sums of money to be divided among my said children and the children of my deceased son
<br />Ashbel ,?.Porter as hereinabove directed."
<br />from which it appears that at the time of the death of said Irving A.Porter the title to said real
<br />estate vested in Charles M.Porter as trustee; that said Charles M.Porter took possession of said
<br />real estate and performed the duties imposed upon him as such trustee under the terms of said will
<br />from that time until the 10th day of November, 1917; that during said time he sold and disposed
<br />of a large portion of the real estate above described; that a portion of the real estate so sold
<br />was under contract providing for payments extending over a considerable period of time, some of
<br />which contracts have not been completed; that the title to such parts or parcels of said real
<br />estate has not been conveyed 'by said trustee.
<br />The Court further finds that on the 10th day of November, 1917, said Charles M.Porter died testato,
<br />leaving him surviving: Harriet E.Porter, his widow; Irving D.Porter, his son; Sarah H.Porter,
<br />his daughter; Charles A.Porter, his son; Mabel C.Porter, his daughter; Dorothy E.Porter, his daug#-
<br />ter; Ruth Porter, his daughter; Ella M.Hammerschmidt, wife of George Hammerschmidt, his daughter;
<br />his only heirs at law and next of kin.
<br />The Court further finds that on the 17th day of December, 1917, letters testamentary were issued
<br />by the Probate Court of Cook County, Illinois, on the Will of said Charles M.Porter, deceased, to
<br />Harriet H.Porter and Irving D.Porter.
<br />The Court further finds that at the time of the death of said Charles M.Porter there was vested
<br />in him as trustee under the Will of Irving A.Porter, deceased, the title to the f olowing describ-
<br />ed real estate situated in the State of Illinois, to -wit:
<br />The West half of Block one (1), all of Block two (2), Lots one (1),two (2), three (3'), ten (10),
<br />thirteen (13), fourteen (14), fifteen (15), sixteen (16), eighteen (18), nineteen (19), twenty -
<br />two (22) and twenty-three (23), in Block three (3), and Lots five (5), six (6) and seven (7) in
<br />Block four (4) in Hillside, a subdivision of part of the East thirteen hundred and twenty -three
<br />(1323) feet lying South of the railroad in the Northeast quarter of Section eighteen (18), Town-
<br />ship thirty -nine (39) North, Range twelve (12), East of the Third Principal Merida.n..in Cook Count,
<br />Illinois.
<br />That part of the Southeast quarter of Section seven (7), Township thirty -nine (39) North, Range
<br />twelve (12), East of the Third Principal Meridian in Cook County, Illinois, South of Indian Bound
<br />ary Line and South of Butterfield Road.
<br />The Fast half of the Northeast quarter of Section eighteen (18), Township thirty -nine (39) North,
<br />Range twelve (12). East of the Third Principal Meridian in Cook County, Illinois, South of Butter
<br />field Road and North of Railroad.
<br />That part of the West half of the Northeast quarter of Section eighteen (18), Township thirty -ni
<br />(39) North, Range twelve (12), East of the Third Principal Meridian in Cook County, Illinois,
<br />lying North of Indian Boundary Line and South of Butterfield Road (except Railroad right of way).
