<br />she never qualified as such Executrix, made no report or settlernent of said estate, and died in
<br />Hall County, Nebraska, on June 9, 1910, without having completed administration thereof.
<br />The Court further finds that afterwards, on petition of Carrie E. Abbott, one of the heirs at
<br />,law and devisees of said testator, and interested in his estate, filed herein, this Court appoint-
<br />jed W. L. Sprague as Administrator with the will annexed, who has duly qualified as such, filed an
<br />;inventory of the estate and property owned by said testator at the time of his death, as by law
<br />1provi de d.
<br />The Court further finds that said ,Tames M. Weldon, deceased, died seized of the follmwing des
<br />Icribed real estate situate in Hall County, Nebraska, to -wit: The West Half of the Southeast Quar-
<br />ter of Section Thirty -four, Township Ten, North, Range Twelve, and the Northwest Quarter of the
<br />Northeast Quarter of Section Three, in Township Nine, North of Range Twelve, West, and Lots Six
<br />and Seven of Section Six, in Township Nine, North, Range Eleven hest; that under the terms and con
<br />�ditions of the will of said deceased, said above premises were devised to Jane Weldon, for and dur
<br />ling her natural lifetime, and the remainder over in fee to his children (designated in said Will a
<br />I
<br />!his heirs), as follows: Fidelia J. Ward (now Fidelia J.Graveline), Adelia E. Maltman, Carrie F.
<br />Abbott, -and James K. Weldon, as tenants in common, and said real estate is so awarded to them as
<br />i
<br />�oF the date of allowance of said will. That said Jane Weldon. widow of said deceased, died intes-
<br />tate on June 9, 1910, and her interest and life estate in said premises thereupon terminated, and
<br />that the said above named children and heirs at law and devisees of said testator took title to
<br />said premises as tenants in common.
<br />IT IS THERFFORF BY THF; COURT ADJUDGRD, IZCREED END CONSIDERED that the said final report of
<br />lsaid Administrator with the will annexed is in all things confirmed, allowed and approved; that t
<br />above described real estate, of which said James M. Weldon. deceased, died seized, passes and des-
<br />cended cended at his death under the terms of his said last will and testament, to his said widow, Jane
<br />eldon (now deceased) for and during her natural lifetime, and the remainder in fee in equal share
<br />to his said children and heirs at law, as sole residuary legatees, to -flit: Fidelia J.Ward (now Fi-
<br />de lia J.Graveline), Adelia E.Maltman, Carrie E.Abbott, and James M.Weldon, as tenants in common,
<br />d same as so awarded to them as of March 20th, 1888, when said will was duly allowed and admitte
<br />to probate; that said estate is closed, said Administrator discharged, and his bond released.
