<br />Nebraska, on the 13th day of October, 1917, and that he left a last will and testament which in-
<br />strument was duly filed in this office for probate, and that after notice given as the law provided
<br />said last will and testament was duly proved, allowed, and admitted to probate on the 12th day of
<br />November, 1917, and entered of record in this office.
<br />The Court finds that the said Henry Flyr left surviving him as his heirs at law and legatees
<br />!the following named persons: Johanna F. Flyr, his widow, and Wilke H. Flyr, Christina V. Dar-
<br />t
<br />'ling, Maria B. Flyr, Bernhard H. Flyr, Katherina A. Oliphant, 011ie C. Flyr Smeaton, Walter F.
<br />JFlyr, Harm H. Flyr, his children.
<br />The Court finds that the said Henry Flyr died seized in fee of the following described real
<br />�Iestate situate in the county of Hall and the State of Nebraska, to -wit:
<br />! The South East quarter (SEJ) of Section Twenty -nine (29) in Township Nine (9) North, Range
<br />;Ten (10) West, consisting of 160 acres, and that under the terms and provisions of said last will
<br />and testament all of said real estate did pass and descend at the death of the testator to Johanna
<br />F. Flyr, his widow, subject to the payment by her of the sum of Two Hundred Dollars (4200.) to eac
<br />lof the children of the said Henry Flyr and that this bequest has been paid by her in every case as
<br />i
<br />shown by the receipts of the several legatees now on file in this office.
<br />IT IS THEREFORE CONSIDERED AND AD.YUDGED BY THE COURT that the South East quarter (SEJ) of
<br />,Section Twenty -nine (29) in Township Nine (9) in Range Ten (10) in Hall County, Nebraska., did pass
<br />and descend at the death of Henry Flyr, under the provisions of his last will and testament to

<br />!Johanna F. Flyr in absolute title.
<br />The Court finds that the said Johanna F. Flyr has paid the inheritance tax assessed against
<br />the estate going to her by virtue of the terms of said last will and testament.

<br />First I order and direct that Executrix hereinafter named ay all my.,iust debts and fun-
<br />eral expenses as soon after mfr deceased as conveniently may be.
<br />Second. After the payment of such funeral expenses and debts. I give, devise and bequeath un-

<br />Lastly, I make, constitute and appoint Johanna F. Flyr, my wife, to be Executrix of this my
<br />j last Will and Testament, hereby revoking all former Wills by me made.
