<br />Klose, late a resident of Lincoln, Lancaster County, died in said Lincoln, November 18 1917, leav
<br />ing a last will.and testament which is now on file in this Court; that said will nominated Nellie
<br />Klose as Executrix, and she is willing to accept said trust; that said decedent died seized of re
<br />estate in Hall, Hamilton and Lancaster Counties, and of personal property in the State of Nebrask
<br />That the devisees, legatees, heirs at law in the absence of a will, and other persons interesit-
<br />ed in said matter, are as follows: Nellie Klose, age 34, widow, Eugene Klose, Age 10, Alfred Klos�e,
<br />%ge 7,and John Charles Klose,
<br />age 1, sons and .Trances Klose, age 5, daughter, all of Lincoln, Nebraska.
<br />Prays that a day be fixed for hearing the proof of the execution of said instrument, and t hgt
<br />fall parties interested be notified to show cause, why said instrument should not be recorded as
<br />(the last will and testament of said deceased, and why administration of said — should not be granted
<br />to Nellie Klose, as Executrix.
<br />November 23 1917 Court orders that said matter be heard December 18 1917 at 10 o'clock A M,
<br />and that notice thereof be published once each week for three consecutive weeks prior to said date
<br />of hearing in the Nebraska Legal News of Lincoln, Nebraska.
<br />December 10 1917 filed the affidavit of Mary E Butler, that she is editor and publisher of
<br />the Nebraska Legal News, a legal weekly newspaper printed, published and of general circulation
<br />in Lancaster County, Nebraska, and that the attached printed notice was published in said news-
<br />paper once each week for three consecutive weeks prior to said date of hearing, the first inser-
<br />tion having been on November. 24.1917.
<br />Attached is a printed copy of a notice by the County Judge, to all persons interested in sai
<br />estate, that a petition has been filed for probate of the last will and testament of said decease
<br />and for appointment of Nellie Klose as Executrix thereof, and that same has been set for hearing
<br />December 18 1917 at 10 o'clock A.M.
<br />December 18 1917 from the evidence adduced, the Court finds that said deceased, then of sane
<br />mind and lawful age, signed said written instrument July 5 1912 in Lancaster County, and at the
<br />same time published and declared said instrument to be his last will and testament, in the pres-
<br />ence of F B Sidles and Nicholas Ress, competent persons, who at the same time attested the same,
<br />and subscribed their names as witnesses thereto, in the presence of and at the request of said de-
<br />ceased; that said deceased at the time of death was a resident of Lancaster County, and died Nov -
<br />ember 18 1917, and the instrument offered for probate herein is the last will and testament of
<br />said deceased.
<br />Therefore ordered, adjudged and decreed that said instrument be admitted to probate as the
<br />(last will and testament of said deceased, and that the execution of said last will be committed
<br />and the administration of said estate granted to Nellie Klose as Executrix, conditioned on her
<br />(giving a bond in the sum of $100000.00, and taking the oath of office.
<br />December 24 1917 approved and filed the bond of said Nellie Klose as Executrix, and letters
<br />testamentary- were issued to her, she having subscribed the oath December 18 1917.
<br />December 24 1917 Court orders notice to creditors that the time limited for presentation and
<br />filing of claims against said estate is May 15 1918, and for payment of debts as Tanuary 15 1919;,
<br />that I y 15 1918 at 2 o'clock P M is assigned for the Court to receive, examine, hear, allow or
<br />lad,iust all claims filed.
<br />Notice hereof is ordered published weekly for four consecutive weeks Within 40 days herefrom,
<br />in the Nebraska Legal News of Lincoln, Nebraska.
<br />January 22 1918 filed the affidavit of Mary E Butler, that she is editor and publisher of the
<br />Nebraska Legal News, a legal weekly newspaper, printed, published and of general circulation in
<br />Lancaster County, Nebraska, and that the attached printed notice was published in said newspaper
<br />once each week for four consecutive weeks prior to said date of hearing, the first insertion hav -
<br />ling been on December 29 1917.
