<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.

<br />Now on this 14th day of lVarch, 1918, it satisfactorily appearing to the Court that notice by
<br />publication has been given to all persons interested as required by order of Court, dated February
<br />26th, 1918, this cause came on for hearing upon the final report of Frank Ewoldt and Fred P. Drei-
<br />bus, Executors of the last will and testament of Claus H. Ewoldt, deceased.
<br />On examination of said report the Court finds that the same is correct and ought to be approv.
<br />ed, and that there is now no money or other property in the hands of the Executors for distributio0E
<br />The Court finds that creditors of the said Claus H. Ewoldt, deceased, were allowed three
<br />months from the 22nd day of October, 1917, in which to present their claims in the office of the
<br />County Judge of Hall County, Nebraska, or be forever barred; that the time allowed for filing
<br />claims has fully expired; that notice was given to all creditors by publication for four successiv
<br />weeks as required by order of Court, dated September 22nd, 1917; that all claims filed and allowed
<br />against said estate have been paid and satisfied and that all claims outstanding against the said
<br />:Claus H. Ewoldt, not filed in the office of the County Judge, if any such exist, are ` therefore
<br />.forever barred and excluded.
<br />It is therefore considered by the Court that all persons are forever barred from filing or
<br />'setting
<br />up any
<br />claims
<br />or demands against the estate of the said Claus H. Ewoldt and the said es-
<br />tate is
<br />fully
<br />settled
<br />and closed.
<br />The Court finds that the Inheritance Tax, duly assessed against said estate,has been paid.
<br />The Court finds that the said Claus H.Ewcldt departed this life on the 31st day of July,1917,
<br />',being at the time of his death a resident of Hall County, Nebraska; that he left a last will and
<br />.testament, which instrument was duly proved, allowed and admitted to probate on the 22nd day of
<br />!September, 1917-
<br />The Court finds that the said Claus H.Ewoldt, died seized in fee of the following described
<br />real estate, situate in the County of Hall, and State of Nebraska, to -wit:

<br />(SWJ) of Section Twenty
<br />five
<br />(25), and the
<br />West One
<br />Half
<br />(W2)
<br />of the North West Quarter
<br />(NW-41) of
<br />Section Thirty -six (36)
<br />all
<br />in Township
<br />Eleven (11) in Range Ten (10) West of the 6th P.V. , and
<br />i Lots Five (5) and Six (6) in Block Three (3) of South Grand Island, being a part of the North
<br />!West Quarter (NW-) of Section Twenty -two (22) in Township Eleven (11) North, of Range Nine (9) Wes
<br />of the Sixth P.M.
<br />The Court finds that the said Claus H.Ewoldt, deceased, left surviving him as his heirs at
<br />law and legatees the following named persons:
<br />Dorothea Ewoldt, his widow, Frank Ewoldt, his son, Lizzie Plahn, Meta Schwieger, Frieda Drei-
<br />+bus, and Dora Mathiesen, his daughters, and Elizabeth Opp, Erhard Opp, Frank Opp, and Tilliam Opp,
<br />;his grandchildren.
<br />The Court finds that under the terms and provisions of said last will and testament, all of
<br />;the above described-real estate did pass and descend at his death to the said Dorothea Ewoldt, his
<br />widow, for her use during her natural life, she to occupy the home in Lots Five (5) and Six (6) in
<br />Block

<br />Hall County, Nebraska, and
<br />that at her

<br />fir. Hall County, Nebraska, does pass and descend,under the provisions of said last will and testa -
<br />'went, to Frank Ewoldt, son of the testator, in absolute title, subject however, to the payment by
<br />the said Frank Ewoldt of the following sums, to -wit:
