<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />,In the matter of the estate of)
<br />F I N A L D E C R F F.
<br />John Harper,.........deceased.)
<br />Now on this 16th day of June, 1917, this cause came on for hearing upon the final report of
<br />I.Tohn Edward Harper, administrator of the estate of John Harper, deceased, it appearing to the
<br />satisfaction of the court, from the proof now in file, that notice of the filing of said report
<br />land of the time and place fixed for the hearing thereon has been given to all person interested by
<br />jpublication of such notice for one week prior to the 16th day of June, 1917, in the Grand Island
<br />Semi- weekly Independent, a legal newspaper, as required by the order of court dated June 6th,1917,
<br />;and there being no objection or protest on file, and no one having appeared to object to or protes
<br />lagainst the allowance of said final report.
<br />On consideration of the testimony, the report and the files of this office, the court finds
<br />that said report is correct in all respects and ought to be allowed; that the administrator has
<br />laccounted for all of the estate which came into his hands and that there remains no money or othe
<br />(property in his possession for distribution.
<br />It is, therefore, considered and adjudged by the court that said report be and the same here
<br />Iby is approved and allowed as and for the final account of said administrator.
<br />The court finds that said John Harper departed this life on the 29th day of May 1916, and
<br />that he was immediately preceding his death, a resident of Hall county; that he died intestate;
<br />that he left surviving him as his heirs at law and his only heirs at law the following named per-
<br />(sons: Lucinda J. Harper, his widow; Emma. J. Reisland, Samuel D.Harper, Nora M. Brunner, Bertha
<br />(Stone and John Edward Harper, his children;
<br />The court finds that the said John Harper died possessed in fee of the following described
<br />Ireal estate situate in the county of Hall and State of Nebraska, to -wit:
<br />All of Block No. Five (5) in Brett and Johnson's Addition to good River, and Lot No. Two (2)
<br />lin Block Three (3) in Dodd and Marshall's Addition to Wood River.
<br />The court finds that under and by virtue of the law of descent of the State of Nebraska, all
<br />lof the above mentioned and described real estate did pass and descend at the death of the said
<br />(John Harper in the manner following, to -wit:
<br />To Lucinda J- ,Harper, widow of the said John Harper, one -third part thereof; AND
<br />To Emma J. Reisland, Samuel D. Harper, Nora M. Brunner, Bertha Stone and John Edward Harper,
<br />Children of the testator, two- thirds of said real estate, in equal shares as tennants in common,
<br />subject, however to the homestead right of the said Lucinda J. Harper, widow, in and to said real
<br />estate.
<br />It is therefore by the court considered and adiudged that all of Block 5 in Brett and John-
<br />son's Addition to the village of Wood River, in Hall County, Nebraska, and Lot 2 in Block 3 in
<br />Dodd and Marshall's Addition to the village of Wood River, in Hall county, Nebraska, did pass
<br />descend at the death of John Harper under the law of descent of the State of Nebraska, in,the
<br />manner following, to-wit:
<br />To Lucinda J. Harper,
<br />To Emma J.Reisland,
<br />To Samuel D. Harper,
<br />To Nora M, Brunner.
<br />To Bertha Stone,
<br />To John Edward Harper
<br />one-third part
<br />two - fifteenths
<br />two - fifteenths
<br />two - fifteenths
<br />two - fifteenths
<br />,two-fifteenths
<br />thereof,
<br />part thereof,
<br />part thereof,
<br />part thereof,
<br />part thereof, and
<br />part thereof.
<br />The above named children of the said John Harper, deceased, taking subject to the homestead right
<br />of the said Lucinda J. Harper in and to said real estate.
<br />The court finds that by order of court dated July 3, 1916, creditors of the said John Harper,
<br />deceased, were allowed six months from the 24th day of July, 1916, in which to present their cla.in
<br />with the proof thereof in the office of the County Judge of Hall County, Nebraska, for allowance;
