I IGLBZ <br />u <br />1 <br />1 <br />1 <br />FINAL DECREE : - <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />VA\. <br />IIn the matter of the Estate of) <br />D C REE. <br />;John Ward, Deceased.) <br />Now, on this 27th day of February, 1918, this cause came on for hearing upon the petition of <br />!Emily Harris, heretofore filed herein, praying the Court to determine and find the date of the <br />!death of the said John Ward, deceased, that the said John Ward died intestate, that the heirs at <br />i <br />law of the said John Ward be determined by the Court, and their respective degree of kinship fixed <br />Viand that the right of descent of the real estate of the said John ward, deceased, in the state of <br />!Nebraska, be determined, and it appearing to the Court, from the proofs on file that due and legal <br />;notice by publication has been given as by law and the order of this Court required, to all credi- <br />1 <br />!tors, heirs, and persons interested in the estate of said deceased, of the time of the filing of <br />said petition and of the time and place fixed for the hearing thereon, which time was for more <br />'than 30 days and less than 60 days after the filing of said petition, and there being no objecti <br />(thereto, said cause was duly submitted to the Court, upon the petition and the evidence produced <br />by the petitioner in support thereof, and the Court being fully advised in the premises, finds tha <br />the said John Ward died intestate in Hall County, Nebraska, on the 22nd day of January, 1904, and <br />!that at the time of his death, the said John Ward was a resident and inhabitant of the county of <br />Hall and state of Nebraska; that the said John Ward died seized of an estate of inheritance in <br />;real estate located in Hall County, Nebraska, consisting of the ownership in fee simple of Lot <br />Number 17, and the South 170 feet of Lot Number 15, all in the County Sub Division of a part of th <br />South Half of Section 5, in Township Number 9, North of Range Number 9 Wdst of the Sixth P.M., and <br />!more than 14 years have elapsed since the death of the said John Ward, and that no application ha <br />i <br />ever been made in the state of Nebraska for the appointment of an administrator of his estate, no <br />Chas administration upon the estate of the said John Ward, deceased, ever been had in the state of <br />!Nebraska; that the petitioner herein is now the owner of an estate of inheritance in said Lot Nurn- <br />! <br />lber 17, of the County Sub Division of a part of the south half of Section 5, in Township 9 North, <br />Range •9 West of the Sixth P.M., and is a competent and proper person to institute and prosecute <br />this proceeding. <br />The Court further finds that the said John Ward left surviving him as his heirs at.law and hi <br />only heirs at law, Isaac T. Ward, a son, Hattie 11. Hackler, a daughter, and Waldo Ward, a son, and <br />that he also left surviving him. Eliza A. Ward, his widow; that upon the death of the said John Wa <br />under the laws of the state of Nebraska, in force at the time of his death, the real estate herei <br />before described passed and descended in equal shares to the said Isaac T. Ward, Hattie M. Hac klerl.. <br />and Waldo Ward, one - -third each, as tenants in common, subject only to the dower estate .therein of <br />the said Eliza A. Ward, surviving widow of the said John Yard, deceased. <br />The Court further finds that at the time of the death of the said John Ward, the real estate <br />! hereinbefore described was of the gross value of about 12000, and is now of the gross value of <br />!about $2500. <br />The Court further finds that the said John Ward, deceased, left a personal estate sufficient <br />Ito pay his funeral expenses, and debts, and that such funeral expenses and debts have been fully <br />paid; that if any debts existed against the estate of said John Ward, deceased, such debts are.lor. <br />since 'warred by the Statute of Limitations, and are now forever barred and precluded, and the Couz <br />further finds that the cost of this proceeding has been paid in full. <br />IT IS TNF-REFORF 0RDFRFD, ADJUDGED AND DFCTTED BY THE COURT that the said John lard died in- <br />!testate in Hall County, Nebraska, on the 22nd day of January, 1904, and that at the time of his <br />jdeath he was a resident and inhabitant of Hall County, !Nebraska; that more than 14 years have elaple- <br />led since the death of the said John Ward; that no administration has ever been had or applied for <br />1upon the estate of the said John Ward, deceased, in the state of Nebraska; that the said John W <br />
