Now on this 25th day of January, 1918, this cause came on further to be heard and after a ful
,examination of the filing of the record pertaining to the estate of August Jaenicke, deceased, the
Court being fully advised in the premises, finds as follows:
That August Jaenicke departed this life on the 10th day of May, 1917, being at the time of hi
death a resident of Hall County, Nebraska. and that he left a last will and testament which instru!
ment was duly filed in this office for probate,and, after legal notice, by publication, was given
to all persons interested, said last will and testament was duly proved, allowed and admitted to
probate, and entered of record in this office.
The Court finds that by a decree of Court, made and entered on the 23rd day of June, 1917,
°creditors of the said August Jaenicke, were allowed six months from the 23rd day of July, 1917, in
which to present their claims in the office of the County Judge of Hall County, Nebraska, for al-
.lowance and that notice of the time allowed and place appointed for filing claims against said es-
tate was given to all persons interested by publication of such notice for four successive weeks ii
the Cairo Record, a legal newspaper; that the time allowed for filing claims has fully expired;
that all claims filed and allowed against the estate of said deceased have been paid and satisfied
and that all claims existing against said estate and not filed within the time limited, if any
isuch,there be are therefore forever barred and excluded.
i
The Court finds that each of the $5.00 bequests to the children of the testator has been paid]
by the Executrix as shown by the receipts of the legatees, now on file in this office, and that
said legatees have severally waived the filing of a final report by the Executrix, waived a statu -I
Cory notice to them of the filing of any report and have requested the Court to enter a final de-
tree, without notice.
The Court -finds that the said August Jaenicke died seized in fee of the following described
;real estate, situate in the County of Hall, and State of Nebraska, to-wit:
j
An undivided one half interest in Lot One (1) in Block Sixteen (16) in Bonnie Brae
Addition to Grand Island.
I
The Court finds that under the provisions of said last will and testament all of the right,
i
;title and interest of the testator in and to the above described real estate, to -grit: Lot One (1),
Block Sixteen (16) in Bonnie Brae Addition to Grand Island, in the County of Hall and State of
Nebraska, did pass and descend at the death of the said August Jeenicke to Maria Jaenicke, widow
!of the testator, in fee simple, and that all of the personal property belonging to the testator at
the time of his death, after the payment of the debts, funeral expenses, expense of last sickness,1
costs of administration and the cash bequests to his children, passed to and became the property
of the said Maria Jaenicke.
It is therefore considered by the Court that all of the interest of the testator in and to
!Lot One (1) in Block Sixteen (16).in Bonnie Brae Addition to Grand Island in Hall County, Nebraska
'did pass and descend at his death under the provisions of his last will and testament to Maria
+Jaenicke, his widow.
It is further considered by the Court that all persons are forever barred from filing or set-
ting up any claims or demands against the estate of August Jaenicke, deceased, and said estate is {
{
fully settled.
