<br />The Court further finds that due and legal notice has been given to all persons of the time
<br />and place fixed for presenting claims against said estate, and that the time so fixed has fully
<br />expired, and that all persons having claims against said estate, if any such there be, and not
<br />'filed within the time limited in said notice, are forever barred and excluded.
<br />The Court further finds that the said Julius Guendel died testate, and that his last will
<br />testament was duly proven, allowed, and admitted to probate herein, on the 27th day of March, 190
<br />and that Anna T. Guendel, widow of said deceased, has duly elected to accept the terms of said wil .
<br />The Court further finds that under the provisions of the last will and testament of the said
<br />Julius Guendel, deceased,the westerly fifty -six (56) feet of Lot Number Seven (7) in Block Number
<br />Ninety-nine (99) in Railroad addition, passed and descended, by absolute title, to Florence Guen-
<br />!del, daughter of said Julius Guendel, deceased.
<br />The Court further finds that under the provisions of the last will and testament of the said
<br />!Julius Guendel, deceased, the easterly ten feet of Lot Number 7, and all of Lot Number 8, in Block
<br />Number 99, in Railroad Addition to the city of Grand Island, Nebraska, did pass and descend, by
<br />!absolute title, to Arthur Guendel, Emil Guendel, and Florence Guendel, share and share alike, sub. -
<br />Iject however, to a life estate therein, of Anna T. Guendel, surviving widow of said Julius Guendel,
<br />!deceased.
<br />The Court further finds that under the provisions of the last will and testament of said .Tu 1-
<br />'ius Guendel, Deceased, the title to the center one -third of Lot Number 7, in Block Number 54, of
<br />jthe original town (now city) of Grand Island, Nebraska, and the Southeast Quarter (831) of the
<br />;Southeast Quarter (SEI) of Section Number Thirty -five (35) in Township Number Twelve (12) North,

<br />'Range Number Eight (8) West; the South Half 0J) of the Southwest Quarter (SW-41) of Section Number
<br />Thirty-six (36) in Township Number Twelve (12), North, Range Plumber Eight (8) West; Island Tract,
<br />in Section Number One (1) conveyed to Julius Guendel, by deed recorded in Book X of Deeds at
<br />497 and 498 of the deed records of Merrick County, Nebraska, containing 50.33 acres, a little more
<br />or lose; the Northeast Quarter (N.EI) of the Northeast Quarter (NEI), Lot Number One (1), and Lot
<br />Number Five (5), in Section Number Two (2), all in Township Number Eleven (11), North, Range Num-
<br />ber eight (8) West. in Merrick County, Nebraska. and being the same premises as is described as
<br />I "my Merrick County, Nebraska, farm" in the fifth paragraph of the last will and testament of said
<br />'Julius Guendel, deceased, passed and descended, by absolute title, to Arthur Guendel, Emil Guendel,
<br />and Florence Guendel, share and share alike, subject, however, to the right of Anna T. Guendel,
<br />'to the income therefrom so long as the said Anna T. Guendel remains unmarried, after the death of
<br />the said Julius Guendel, deceased.
<br />IT IS T HM",FORF ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of the said
<br />�Charies R. Heusinger, and Richard Guendel, as Executors of the last will and testament of the said
<br />;Julius Guendel, deceased, be, and the same hereby is in all things allowed, and approved as and fb
<br />'the final report of said Executors, said Executors are discharged. their bond released, and said
<br />i
<br />estate closed.
<br />j IT IS FURTHER ORnFRFD, ADJUDGED, AND DECREED BY THE COURT that all persons having claims
<br />'against said estate and not filed within the time provided by notice given for creditors to pres-
<br />lent claims, if any such there be, are forever barred, enjoined, and excluded from setting up, or
<br />asserting any such claim against the estate of said Julius Guendel, deceased.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under the last will and testa-
