<br />!concluded from filing or setting up any claims against the estate of David Elijah, and said estate
<br />is fully settled and closed.
<br />It is further considered that all of the right, title and interest of David Elijah in and to
<br />the South West Quarter of Section Eighteen in Township Ten in Range Eleven in Hall County, Nebrask,
<br />'did pass and descend at his death, under the terms of his last will and testament, in the manner
<br />following; one fourth part thereof to Edmund Elijah; one fourth part thereof to Louisa Coates;
<br />one fourth part thereof to Mary Ann Johnson; and the remaining one fourth part thereof to W. E.
<br />Elijah, James H. Elijah, Margaret Jr. Bennett, and Jessie I. Deming, children of Allen Elijah, a
<br />brother of the Testator, in equal shares and as tenants in common.

<br />I, David Elijah of Clarence, Cedar County,. State of Iowa, being of sound mind and memory ant
<br />of full age do hereby make, publish and ordain this my last will and testament, hereby revoking a7
<br />former wills by me made.
<br />1st. After the payment of all my just debts and the expenses of my last sickness and funeral
<br />I direct that my executor proceed at once to settle and close my estate, and subject to said debtsg,
<br />and expenses, I give, devise and bequeath to my brother Allen Elijah the sum of Two Thousand Dollars.
<br />2nd. I give, devise and bequeath to my brother Thomas Elijah the sum of One Thousand Dollars.
<br />3rd_ I give, devise and bequeath to my nephew Fred H.Elijah, the sum of Two Thousand Dollars.
<br />4th, I give, devise and bequeath to my niece, the wife of my nephew, Fred H.Elijah, the sum
<br />of Two Thousand Dollars.
<br />5th I give, devise and bequeath to my nephew, Ward E.Benson, the sum of One Dollar.
<br />6th. I give, devise and bequeath to my nephew W.H.McKerral, the sum of One Dollar.
<br />7th. All the residue and remainder of my estate I direct to be divided into four equal parts
<br />or shares, and to my brother Edmund Elijah I give, devise and bequeath one of said shares; to my
<br />sister, Louisa Coates, I give, devise and bequeath one of said shares; to my sister, Mary Ann John -
<br />son, I give, devise and bequeath one of said shares; and the remaining one of said.shares I give,
<br />"devise and bequeath to the children of my brother Allen Elijah, towit: W.E.Elijah, James H.Elijah,
<br />Margaret J.Bennett and Jessie I.Deming, to be divided equally among said four children of my brotho
<br />8th. Should any of the beneficiaries named herein die before my decease I give, devise and be-
<br />queath the share herein given to such beneficiary to his or her heirs.
<br />I hereby nominate my brother, Edmund Elijah as executor of this my last will and testament and
<br />request that he not be required to give bond as such.
