162 MLL AND DEGREE RECORD No. 2 <br />..._..-- ..__._. _�: <br />paid and satisfiea; that all claims outstanding against Laid estate, and not so filed and within <br />the time above limited, are tnerefore forever barred and excluded. <br />It is therefore considered by the Court that tale report of the executor J.L.Senseney be and <br />the same hereby is, approved and allowed as and for his final account. <br />It is further considered by the Court that all persons are forever barred and precluded from <br />f i ling or settin -T up any claims or demands against the estate of Theodore Pucnert, deceased, and <br />that said estate is fully settled and closed. <br />The Court finds that the said Theodore Puchert departed this life on the 12th day of October, <br />1916, being at the time of his death a resident of Hall County, Nebraska, and that he left a last <br />will and testament which instrument was duly proved, allowed and admitted to probate in this <br />Court on the 28th day of October, 1916. <br />The Court finus that said Theodore Puchert, was at the time of his death the owner in fee <br />simple of tAe following described real estate situated in the County of Hall and State of Nebrask <br />to -wit: the east Half (Ea) of the north east quarter (NE4) and the North half (Y ) of the south <br />east quarter (SE-4 ) of Section Twenty -one (21) in Township Ten (10) north of Range Eleven (11) wes <br />of the Sixth principal Meridian, Lots Numbered One (1) and Two (2) of Section Twenty -eight (28 ) <br />in Township Ten (10) in Range Eleven (11) west of the Sixth P.M. containing Fifty -seven ( -7) acre <br />and Ninty- hundreths of an acres (90/100), <br />The Court finds that the testator Theodore Puchert in his last will and testament directed <br />that all of said above described real estate be sold and that the proceeds of such sale be applie <br />to the payment of the legacies provided for under the terms of said last will and testament and tr <br />the executor of said last will and testament has accordingly in pursuance of the power vested in <br />him sold and transferred all of the above mentioned and described real estate and has applied the <br />proceeds of said sale to the payment of legacies as required under the provisions of said last <br />will and testament. <br />The Court finds that all legacies under the terms of said last will and testament have been <br />paid all of which is shown by the receipts of tree legatees filed in this Court. <br />J.H.Mullin.... County Judge. <br />Last Will and Testament of Theodore Puchert <br />I, Theodore Puchert, of boon River, Nebraska, considering the undertainties of this mortal <br />life, and being of sound mind and memory, do hereby make, publish and declare this my last, will <br />and Testament in manner and form following, hereby revoking and making void all former wills by <br />me made at any time heretofore: <br />First: I direct that my funeral criarges, the expense of awiiinistering my estate and all my <br />just debts be paid out of my personal estate and if that be insufficient, then out of my real <br />estate. <br />Second: I give.and bequeath to my beloved wife Jane Puchert, the sum of Five Thousand 05000.00 <br />Dollars (having heretofore given her my home residence property of the value of $3000.00) in liew(' <br />of any distributive share in my estate to which she would otherwise be entitled. I also give and <br />bequeath to my beloved wife all of my personal estate of whatsoever kind, if any there be, after <br />paying my funeral expenses, expense of administration and just debts as. heretofore' provided. <br />Third: <br />LR <br />I give and bequeath unto my son Mino G.Pucnert the sum of Six Thousand ($6000.00) Dollars. <br />Fourth: I give and bequeaths to my son Henry J.Puenert the sum of Two Thousand ($2000.00) Dollars. <br />fifth: I give ana bequeata to guy son John F.
