<br />Hans Ewoldt, aecease(a. )
<br />Now on this 27th day of September, 1917, this cause came on for hearing after due notice by
<br />publication as required by order of Court dated September 15th, 1917, upon the final report of
<br />Auguste Ewoldt, executrix of the last will ana testament of hans Ewoldt, deceased.
<br />After a full examination of said report, the Court finus tnat said Executrix has accounted
<br />for all of the estate which came into her possession and that there now remains no money or oth
<br />property in her hands for distribution; that the said Auguste Ewoldt is the sole legatee under
<br />the will and that all of the personal property has therefore been tdrned over to her.
<br />'The court finds that creditors of the said Hans Ewoldt were allowed by order of Court dated
<br />October 4th, 1915, six months from the Stn day of November, 1915, in which to file their claims 1
<br />the office of the County Juu.ge of Hall County, Nebraska; that notice was given to creditors of to
<br />time allowed ana place appointed for filing claims against the estate of said dcoesstd; that the
<br />time so allowed for filing claims h.as fully expired; tnat no claims of any nature were filed
<br />against said estate; that all claims and aemands outstanding against the Baia Hans iwoldt, caec-
<br />easea, if any such tnere are, are therefore forever barren anu excluded.
<br />It is therefore by the court considered that the report of Auguste Ewoldt, executrix, be
<br />the same nereby is approved ana allowea as and for her final account, and she is aischarged of
<br />her trust.
<br />It is further considered by the court that all persons are forever barred ana precluded fr
<br />filing or setting up any claims or aemanas against the estate of Hans Ewoldt, aeceasea, ana that
<br />said estate is fully settled and closed.
<br />The court finds that the said Hans Ewoldt departed this life on the 30th day of August,19151
<br />being at the time of his aeath a resident of Hall county, Nebraska; that he left a last will and
<br />testament xc iicft instrument was duly proved, allowea ana admittea to probate in this court on the
<br />2nd day of October, 1915.
<br />The court finds that said Hans Ewoldt died possessed in fee of the following described real
<br />estate, situate in the County of Hall and State of Nebraska, to -wit: The Southeast quarter of
<br />the Southwest quarter (SEJ SW4) of the Southeast quarter ( SE4) ana The South Four (4) acres of
<br />the South Half of the iiortheast quarter (S4 NE4) of the Southwest Quarter of the Southeast Quar-
<br />ter (Sw4 SE4 ) of Section Twenty -One (21) in Township Eleven (11), range Nine (9 ), excepting a
<br />strip forty (40) feet wide off the West. side reserved for a public road.
<br />The court finds that by virtue of the provisions of the last will and testament of the said
<br />Hans Ewoldt, deceased, tine above meat ioneu and described real estate aid pass and, descend at the
<br />death of the said Hans Ewoldt in the manner following:
<br />To Auguste Ewoldt, widow of the aeceased,an undivided one -half thereof, and
<br />To Pernhara Ewoldt, a nephew of the testator, the remaining one -half thereof, subject
<br />to the homestead right of the said Auguste Ewolat, in and to Said real estate.
<br />It is therefore by the court, CONSIDERED AiJL ADJUDGED, tnat the SE of the SWt of the SE4i
<br />and the South 4 acres of the Sz of the Nhi of the SW4 of the SE4 of Section 21,in township 11, in
<br />i
<br />range 9, in Hall County, Nebraska, did pass and descend at the death of the said Hans Ewoldt, un
<br />der the provisions of the ,last will and testament to Auguste Ewoldt ana Bernhard Ewoldt, an undi-
<br />vided one -half part to each,and subject to the homestead right of the Auguste Ewoldt, in all of
<br />said real estate.
