<br />Joachim Puttsciau, deceased.
<br />Now on t1rils 20th day of October, 1917, this cause came on for hearing upon the final report
<br />of Josephine ButtscIlau,
<br />executrix of the last will and testament of Joachim BUttschau, deceased,;
<br />It appearing to the Court upon the proof now on file that all persons interested have been noti-
<br />fied as required by law and the order of this Court dated October 10th, 1917, and no one having
<br />appeared to object to or protest against the allowance of said report.
<br />on consideration whereof, the Court being fully advised in the premises, finds that said re-
<br />port 16 correct in all respects and ought to be allowed; that the executrix has accounted for all
<br />the estate which came into her possession, has paid all claims filed and allowed against the es-
<br />tate as well as the funeral expenses and the expenses of administering the estate and that there
<br />remains in her hands for distribution a sum Of $18,855.08; that under the provisions of the last
<br />will and testament of the said Joachim Buttsehau all of the personal property owned by 'him at the
<br />time of his death passed to ana became the property of Josephine Buttschau, his widow, and that
<br />the said Josephine J3uttscftau, executrix should therefore pay to herself as legatee all of the
<br />balance of the money now in her hands. The Court finds that the said Joacnim Buttscl."lau departed
<br />I this life on the 3rd day of March, 1917, being at the time of his death a resicient, of Hall County
<br />Nebraska, and that he left a last will and testament which instrument was duly proved, allowed an
<br />admitted to probate In this Court on the 9th day of March, 1917.
<br />The Court finds that creditors of the said Joachim Buttscliau, deceased, were by the order of
<br />Court J�arcft 9+."1,1.917, allowed six months from the 9th day of April, 1917, in which t6 file their
<br />claims in the office of the County Judge of Hall county iebraska, for allowance or be forever
<br />C
<br />barred; that notice was given to all creditors by publication of such notice for four successive
<br />weeks as required by law at the order of the Court; that the time allowed for filing claim- has
<br />fully expireu and that LL11 claims filed and allowed against said est�,.te have been paid; that all
<br />claims outstanding against ouia Jo.acftim Buttscriau and not so filed, if any such there be, are
<br />IIii therefore forever barred and excluded.
<br />It is therefore Consiuerea by the Court that the report of the executrix be and hereby is,
<br />approved and allowed as and for her final account.
<br />It is further considered ana adJuUgeu by the Court tnat all persons are forever barred from
<br />filing or setting up any claims or demands against the estate of the said Joacnlm Buttscirlau, and
<br />the estate is fully settled and closed.
<br />The Court finds that under and by virtue of the provisions of Vie last will and testament of
<br />joac?ilm, Puttschau, deceased, all of the real estate owned by him at the time Of his death did past
<br />and descend to his widow, Josephine Buttscliau, for her uoeandbenerlt during the term of her natur
<br />al life and that at her death all of said real estate descends under the terms of said last will
<br />and testament to Fred William. ButtScqaU, the son ofl-tae testator, and Minnie Jane Paul, his daugh-
<br />ter, in equal shares.
<br />The Court finds that the said Joachim 13uttscnau was at t210 time Of his aeath the owner in fee
<br />simple of Lots two (2) and three (3) in Block four (4) in first addition to the village of Cairo
<br />in Hall county Nebraska, and that said real estate uebcencLs under the terms of said last will and
<br />jr
<br />te6tw�ient to said Josephine buttschau, for life and at her death to Fred William Buttscftau and
<br />Minnie Jane Paul, children of the testator, share and ahare alike.
<br />It is therefore considered by the Court that Lots two (2) and three (3) in Block four (4)
<br />in the first addition to the village of Cairo in hall County, Nebraska,dia pass and descend at th�
<br />death of Joachim Buttschau under the provisions of his last will and testament to Josephine Butts-
<br />claau, his widow, for the natural term of her life and At her death to Fred William Suttschau, and
