<br />said estate, aria that tree time so fixed has fully expired, and that all claims filed against sal
<br />estate have been paid in full by said Executrix, and that all claims against said estate, of any
<br />such there be, and not filed with this Court within the time fixed by said notice, are forever
<br />barred and excluded.
<br />The Court further finds that the said Ellen T. Barton as such Executrix, has fully accounte
<br />for all property bel6nging to said estate, and coming into her possession under her control, that
<br />she ought to be discharged as such Executrix, and said estate closed.
<br />The Court further finds that the said Silas R. Barton died seized of the following descri
<br />ed real estate,: as owner in fee simple thereof;
<br />Lot number six (6) in block number two (2) in Spalding & Grerg's Addition to the city of Grand
<br />Island, in Hall County, Nebraska, whicn said premises were the home and homestead of the said
<br />deceased at the time of his death.
<br />An undivided one -nalf of lot number eight (8) in block number one hundred- tnirty -one (131) in
<br />Koenig & Wiebe's Addition to Grand Island, in Hall County, Nebraska.
<br />An undivided one -sixth of the southwest quarter (SWI) of section number seven (7) and an undi-
<br />vided one -sixth of the southwest quarter (SWT) of section number eig'lteen (18 ), all in town-
<br />ship number ten (10) north of range number six (6) in Hamilton County, Nebraska, subject how-
<br />ever, to a life estate therein of one Teresa E.Barton, the mother of said Silas R.Barton,deceas,
<br />The Court further finds that by the terms-and provisions of the last will and testament of
<br />the said Silas R.Barton, deceased, all of the real estate hereinbefore described did pass and des
<br />cend, by absolute title, to Ellen T. Barton, his surviving widow, whom the Court finds to be the
<br />same and iuentical person who is named as his wife, Ellen Ia. Barton, in his said last will and
<br />testament.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREER by the Court that the final report of the sai
<br />Ellen T. Barton, as executrix of the last will and testament of tie 6aid Silas R. Barton, be, and
<br />the same hereby is allowed, aria approved, as and for her final report, as such executrix, sie is
<br />discnargped as such executrix, and said estate is fully settled, and closed.
<br />It is further ordered, adjudged ana decreed by the Court tiat all persons having claims
<br />ac:ainst tie estate of the said Silas R. Barton, deceased, if any such there be, are forever barrel,
<br />enjoined, and excluded, from setting up, or asserting, any such claims, against said estate.
<br />It is further ordered, adjudged and decreed by the Court, that by the terms and provisions

<br />Vie last will and testament of tie said Silas, deceased, heretofore proven, allowed, and admitte
<br />to probate, in Viis Court, the title to the real estate hereinbefore described, towit,
<br />lot number six (6) in block number two (2) in Spalding & Gregg's Addition to the city of Grand
<br />Island, in Hall County, Nebraska; an undivided one -half of lot number eight (8) in block number
<br />one hundred thirty -one (131) in Koenig & Wiebels Addition to Grand Island, in Hall County, Neb-
<br />raska; an undivided one -sixth of the southwest quarter (Sw4) of section number seven (7), and an
<br />undivided one -sixth of the southwest quarter (SWT) of section nwaber eighteen (18), all in town-
<br />ship number ten (10), north of range number six (6), in Hamilton County, Nebraska, subject howeve�
<br />to a life estate of one Teresa :E.Barton, in said Hariiilton County, Nebraska, real estate, did pass)
<br />and descend, by absolute title, to Ellen T. Barton, surviving widow of said Silas R. Barton, de-
<br />ceased, site being the same, and iuentical person who is described as Ellen V. Barton in the last
<br />will and testament of tie said Silas R. Barton, deceased.

<br />I give all my property, both real and personal, to my beloved wife, Ellen Too. Barton, and
<br />would pray that she be appointed sole executrix of my estate.
